HomeMy WebLinkAboutCC RESO 14,720RESOLUTION NO. 14,720 RESOLUTION ACCEPTING NEGOTIATED PROPERTY TAX EXCHANGE FOR AMENDMENTS TO SAN DIEGO COUNTY FLOOD CONTROL DISTRICT ACT WHEREAS, in 1984, certain sections of the San Diego County Flood Control District Act were amended by the California State Legislature; and WHEREAS, effective July 1, 1985, all city territory is detached from the San Diego County Flood Control District; and WHEREAS, Section 49 of the San Diego County Flood Control District Act, as amended, states that the San Diego County Flood Control District, the County of San Diego, and any city which is detached from said District as a result of this Act shall negotiate a property tax exchange; and WHEREAS, the San Diego County Auditor and Controller is required to place the base revenue allocated to the Flood Control District in affected territory of cities in an impound account until a property tax exchange has been agreed to by resolutions of the San Diego County Flood Control District, the County of San Diego, and each affected city; and WHEREAS, the San Diego County Flood Control District, the County of San Diego, and affected cities have negotiated a property tax agreement for this jurisdictional change. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City that the distribution of property taxes as a result of this jurisdictional change shall be as follows: All base revenue and all annual tax increment allocated to the San Diego County Flood Control District territory which is being detached as a result of this Act shall be transferred to the City of National City. BE IT FURTHER RESOLVED that all funds received by the City of National City pursuant to this resolution shall be used by the City for flood control objects and purposes pursuant to Section 49 of the San Diego County Flood Control District Act. BE IT FURTHER RESOLVED that the City Clerk shall notify the San Diego County Auditor and Controller of the City's acceptance of this negotiated exchange of property taxes by sending him a copy of this resolution.
