HomeMy WebLinkAboutCC RESO 14,757RESOLUTION NO. 14,757 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA, APPROVINGITENTATIVE MAP FOR THE DIVISION OF 9 ACRES TO FIVE LOTS LOCAT DON THE WEST SIDE OF GROVE STREET, SOUTH OF 14TH STREET. (A.P.N. 557-390-28) (APPLICANT: AL E BEAUCHAMP,1JAMES PATTON) CASE FILE WHEREAS, application was made for approval of a tentative subdivision map to divide .689 acres of property on the West side of Grove Street, South of 19th Street, into 6 lots; and WHEREAS, the Planning Commission of the City of National City considered said application at a public hearing held on August 5, 1985, and by Resolution No. 35-85 dated August 19, 1985 recommended denial of the application on the grounds that the site was not suitable for the proposed development; and WHEREAS, the City Council of the City of National City reconsidered said application at a public hearing held on September 24, 1985, at which time the City Council considered oral and documentary evidence, as well as the record of the proceedings before the Planning Commission, and the entire contents of Case File No. S-1-85, which is incorporated herein by reference; and WHEREAS, this action is taken pursuant to all applicable procedures required by State law and City ordinances; and WHEREAS, the action hereby taken is found to be essential for the preservation of the public health, safety and general welfare. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City that it hereby approves a tentative map for the division of .689 acres (approximately 30,000 square feet) into five lots on the West side of Grove Street, South of 14th Street, based on the following findings: 1. The tentative map is consistent with the National City General Plan. 2. The design or improvement of the proposed subdivision is consistent with the National City General Plan. 3. The site is physically suitable for the single-family residential type of development. 4. The site is physically suitable for the proposed density of development, due to imposition of conditions limiting development to five, single- family residential lots, because of restrictive site topography and surrounding development patterns. 5. The design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and unavoidably injure fish or wildlife or their habitat. 6. The design of the subdivision or the type of improvements is not likely to cause serious public health problems. 7. The design of the subdivision or the proposed improvements will not conflict with easements, acquired by the public at large, for access through or use of, property within the proposed subdivision. 8. The discharge of sewerage waste from the subdivision into the National City sewer system will not result in violation of existing requirements prescribed by the California Regional Water Quality Control Board pursuant to Division 7 (Commencing with Section 13000) of the Water Code, as specified by Government Code Section 66474.6. 9. The Subdivision has been considered by the City Council with regard to its effect on the housing needs of the region, and these needs are balanced by the public service needs of the residents and available fiscal and environmental resources. 10. The design of the subdivision provides, to the extent feasible, for future passive or natural heating and cooling opportunities in the subdivision, based upon considerations of local climate, contour, property configuration and other design and improvement requirements without requiring additional reduction in allowable density or lot coverage. BE IT FURTHER RESOLVED, that the Negative Declaration on file in the Planning Department File No. IS-85-42 has been completed in compliance with the California Environmental Quality Act (CEQA) and State and City CEQA Guidelines, that the City Council has reviewed and considered the information contained therein prior to approving the project and that tentative Map S-1-85, as approved, would not have a significant effect on the environment. BE IT FURTHER RESOLVED, that based on the findings hereinbefore stated, said tentative subdivision map for division of .689 acres into five lots is hereby approved subject to the following conditions: A. The approval of this tentative map expires on October 1, 1987 at 5:00 p.m. unless prior to that date a request for a time extension not exceeding an additional three years has been filed as provided by Section 66452.6 (e) of the California Government Code. B. The following conditions shall be complied with before a final map is approved by the City Council and filed with the County Recorder of San Diego County. 1. The final map shall abide by all the requirements of the Subdivision Map Act and the National City Municipal Code, including certificates, acknowledgements and complete boundary information. 2. The final map shall be recorded prior to issuance of any building permit. 3. The subdivider shall provide evidence that fire flow requirements are available from the Sweetwater Authority to serve proposed structures, and shall enter into an agreement with the Sweetwater Authority for water facility improvements necessary to serve the subdivision, prior to approval of the final map. 4. The following shall be completed to the satisfaction of the City Engineer prior to approval of the final map: a. A soils report addressing proposed 2:1 slope cuts, allowable footing soil pressure and lateral fluid pressure for retaining walls, geology, building pads, etc. b. Improvement or bonding for improvement of Grove Street, by a 20 ft. width along the frontage of the property to be subdivided, along with the sidewalk, curb, and gutter (structural street section shall consist of 3 inches A.C. over 8 inches A.B.). c. Grading plans, indicating: maximum driveway grade shall be 15%, 7 1/2% at the property line; maximum driveway width shall not exceed 40% of proposed parcel frontage; building pads, and elevations, necessary grading and topography; d. e. Grading (or bonding for) grading improvements; Proper monumentation; f. An on -site drainage plan and study, including the method of conveyance of drainage to gutter. The existing 4" curb inlet at 14th Street and Grove Street shall be investigated for capacity. 5. Prior to approval of the final map, the subdivider shall submit and obtain approval of site development plans and building plans to the satisfaction of the City Council to address the following: a. Adequate mitigation from freeway noise, documented by an accoustical study prepared by a qualified accoustical specialist. b. Compatibility of building height, scale, bulk and of other architectural elements with the adjacent single-family, residential area; c. Positive visual image through architectural features and/or landscape improvements visible from the freeway area to the west of the subdivision. d. Adequate outdoor recreational area for individual households. 6. The final map shall comply with conditions required by the National City Municipal Code, Section 17.28, Improvements. 7. A General Plan Amendment residential designation shall be effect prior to approval of the and change of zone to a single-family approved by the City Council and in final subdivision map. 8. The total number of lots shown on the final map shall not exceed five (5). 9. The height of proposed structures on proposed lots shall not exceed 2 stories. 10. Building plans and elevations for proposed lots shall be approved by the City Council prior to approval of the final map. 11. Sidewalk improvements shall be provided contiguous to the curb along the entire Grove Street frontage of the subdivision. BE IT FURTHER RESOLVED that copies of this Resolution be transmitted forthwith to the applicant; and, BE IT FURTHER RESOLVED that, this action will become final and effective on October 1, 1985.
