A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NATIONAL CITY, CALIFORNIA,
APPROVING A TENTATIVE MAP FOR THE DIVISION OF 31.7 ACRES
INTO 19 LOTS LOCATED
SOUTH OF THE SOUTHBAY FREEWAY (SR54) ON BOTH SIDES OF VALLEY ROAD,
NORTH OF LOMACITAS LANE, WEST OF AVENIDA SAN MIGUEL
(APPLICANT: ODMARK DEVELOPMENT COMPANY)
CASE FILE NO. S-2-85
WHEREAS, application was made for approval of a tentative subdivision
map to divide 31.7 acres of property located on both sides of Valley Road between
Lomacitas Lane and Avenida San Miguel; and
WHEREAS, the City Council of the City of National City considered said
application at a public hearing held on November 12, 1985, at which time the City
Council considered oral and documentary evidence, and the entire contents of Case
File No. S-2-85, which is incorporated herein by reference; and
WHEREAS, this action is taken pursuant to all applicable procedures
required by State law and City ordinances; and
WHEREAS, the action hereby taken is found to be essential for the
preservation of the public health, safety and general welfare.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
National City that Subdivision Map S-2-85, a tentative map for the division of 31.7
acres (approximately 500,940 square feet) into 19 lots on property located on both
sides of Valley Road between Lomacitas Lane and Avenida San Miguel be approved
based on the following findings:
1. The tentative map is consistent with the National City General Plan.
2. The design or improvement of the proposed subdivision is consistent
with the National City General Plan.
3. The site is physically suitable for the residential type of
development.
4. The site is physically suitable for the proposed density of
development, of 184 dwelling units on 11.5 acres (Lots 18 and 19)
northside of Valley Road, and, 17 detached single-family dwellings on
one -acre estate lots, south side of Valley Road.
5. The design of the subdivision or the proposed improvements are not
likely to cause substantial environmental damage or substantially and unavoidably
injure fish or wildlife or their habitat.
6. The design of the subdivision or the type of improvements is not likely
to cause serious public health problems.
7. The design of the subdivision or the proposed improvements will not
conflict with easements, acquired by the public at large, for access through or use
of, property within the proposed subdivision.
8. The discharge of sewerage waste from the subdivision into the
National City sewer system will not result in violation of existing requirements
prescribed by the California Regional Water Quality Control Board pursuant to
Division 7 (Commencing with Section 130000) of the Water Code, as specified by
Government Code Section 66474.6.
9. The Subdivision has been considered by the Planning Commission with
regard to its effect on the housing needs of the region, and these needs are balanced
by the public service needs of the residents and available fiscal and environmental
resources.
10. The design of the subdivision provides, to the extent feasible. for
future passive or natural heating and cooling opportunities in the subdivision, based
upon considerations of local climate, contour, property configuration and other design
and improvement requirements without requiring additional reduction in allowable
density or lot coverage.
BE IT FURTHER RESOLVED that the City Council does hereby find and
certify that the EIR and Addendum on file in the Planning Department File No. IS84-
71 and IS85-45 has been completed in compliance with the California Environmental
Quality Act (CEQA) and State and City CEQA Guidelines, that the City Council has
reviewed and considered the information contained therein prior to approving the
project and that Tentative Map S-2-85 is approved after an EIR and Addendum has
been completed which identifies eight significant environmental effects of the project,
and, accordingly, pursuant to Section 15091 of the State CEQA Guidelines, the
following finding is made:
1. Changes or alterations have been required in, or incorporated into, the
project which mitigate and substantially lessen the significant
environmental effect as identified in the final EIR.
BE IT FURTHER RESOLVED, that based on the findings hereinbefore stated,
said tentative subdivision map for division of 31.7 acres into 19 lots is hereby
approved subject to the following conditions:
A. The approval of this tentative map expires November 12. 1987 at 5:00
p.m. unless prior to that date a request for a time extension not
exceeding an additional three years has been filed as provided by Section
66452.6 (e) of the California Government Code.
B. The following conditions shall be complied with before a final map is
approved by the City Council and filed with the County Recorder of San
Diego County.
1. The final map shall abide by all the requirements of the Subdivision
Map Act and the National City Municipal Code, including
certificates, acknowledgements and complete boundary information.
2. The final map shall be recorded prior to issuance of any building
permit.
3. The subdivider shall provide evidence that fire flow requirements are
available from the Sweetwater Authority to serve proposed
structures, and shall enter into an agreement with the Sweetwater
Authority for water facility improvements necessary to serve the
subdivision, prior to approval of the final map.
4. The following shall be completed to the satisfaction of the City
Engineer prior to approval of the final map:
a) All required right-of-way for street, drainage, and sewer purposes
shall be dedicated to the City. This includes all sewer
easements to Sweetwater Road. Dedication inside the property
can be accomplished through the final map. Deeds shall be
submitted for right-of-way outside the property.
b) All street, drainage and sewer improvements and other
improvements shall be constructed, or an agreement to do the
work shall be executed, backed up by security approved by the
City. Work shall be done on plans approved by the City
Engineer as follows:
i) Grass Lined Channel from the South Bay Freeway crossing,
through the project westward to existing dirt channel at the west
endof the property, including drop structures, erosion control
structures, and maintenance road at the N.E. end. Channel shall
be 8' deep with proper landscaping and irrigation for channel.
Installation of sanitary sewer through the project site and
southwestward to connect to the existing public sewer
Sweetwater Road.
iii) Sanitary sewer from Stockman westward to existing 24' trunk
line.
iv) Valley Road widening to 40' curb to curb, including curb, gutter
and sidewalk, and striping for traffic control.
5. The final map shall comply with conditions required by the National
City Municipal Code, Section 17.28, Improvements.
6. The total number of lots shown on the final map shall not exceed 19.
