A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NATIONAL CITY, CALIFORNIA, APPROVING AN APPLICATION FOR
CONDITIONAL USE PERMIT TO ALLOW THE SALE OF BEER, WINE, AND
DISTILLED SPIRITS (TYPE 21 LIQUOR LICENSE) AS AN INCIDENTAL
USE TO A SUPERMARKET ON PROPERTY LOCATED AT
1035 HARBISON AVENUE.
(APPLICANT: ALPHA BETA COMPANY)
CASE FILE NO. CUP-1985-18
WHEREAS, the appeal of the Alpha Beta Company from the Planning
Commission's denial of a conditional use permit (CUP) was considered by the City
Council of the City of National City at a public hearing on November 12, 1985, at
which time oral and documentary evidence was presented; and
WHEREAS, at said public hearing the City Council considered the entire
contents of Case File No. CUP-1985-18, which is maintained by the City, and
incorporated herein by reference; and,
WHEREAS, this action is taken pursuant to all applicable procedures required
by state and City law; and,
WHEREAS, the action recited herein is found to be essential for the
preservation of public health, safety and general welfare.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
National City that the testimony and evidence presented to the City Council at the
public hearing held on November 12, 1985 support the following findings:
1. That the proposed use will not have an adverse effect upon adjacent or
abutting properties because it will be located within an existing
supermarket as an incidental use to the sale of other items.
2. That the site has sufficient access to streets because the project site is
located within an existing shopping center which is located on Harbison
Avenue north of Plaza Boulevard. There is sufficient access from
Harbison Avenue into the shopping center.
3. That the proposed use is adequate in size and shape because the area to
be used for liquor display and sales will be located within a small portion
of the supermarket with the remainder of the floor area being used for
the display and sale of non-alcoholic products.
4. That the proposed use is deemed essential and desirable to the public
convenience and welfare because the sale of alcholic beverages is a
typically permitted incidental use to a supermarket as a convenience to
the patrons of the supermarket.
BE IT FURTHER RESOLVED that the application of the Alpha Beta Company
for a conditional use permit is approved subject to the following conditions:
1. The market shall not be open for business between the hours of 2:00 a.m.
and 6:00 a.m.
2. The sale of alcoholic beverages on the premises is limited to a use
incidental to a supermarket.
3. The display of alcoholic beverages shall be limited to those areas
designated on the floor plan, submitted by the applicant on August 12,
1985. and incorporated herein by reference, for the "Proposed Liquor
Department".
4. Within thirty (30) days of the date of approval of this Conditional Use
Permit, the applicant shall file a written statement with the Planning
Department, acknowledging and accepting all conditions imposed upon the
approval of this permit.
5. The Conditional Use Permit shall expire if use of the property becomes
something other than a major chain supermarket.
BE IT FURTHER RESOLVED that copies of this Resolution shall be
transmitted forthwith to the applicant,
BE IT FURTHER RESOLVED that this Resolution shall become effective and
final on the day following the City Council meeting where the resolution is
adopted.
