RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NATIONAL CITY APPROVING CHANGE ORDER NO. 1
FOR THE CONSTRUCTION OF HARBOR DRIVE AND 8TH STREET PROJECT
BE IT RESOLVED by the City Council of the City of National City
that, pursuant to Resolution No. 13,924, Change Order No. 1 in the amount of
$8,017.39 is hereby approved for the Construction of Harbor Drive and 8th
Street Project.

AGREEMENT FOR CONTINUED FIRE PROTECTION
AND EMERGENCY MEDICAL SERVICE FOR THE
LOWER SWEETWATER AREA
THIS AGREEMENT is entered into this 12th day of December , 1985 by and
between the City of National City and the Lower Sweetwater Fire Protection
District.
WITNESSETH
WHEREAS, the Lower Sweetwater Fire Protection District was organized to
provide fire protection to its citizens, and
WHEREAS, the City of National City lies contiguous to District territory
and maintains professional fire protection and emergency medical service within its
City, and
WHEREAS, the District presently maintains property and equipment to
provide fire protection and emergency medical service and maintains personnel to
supplement the service provided through contract with the City of National City, and
WHEREAS, due to the limitations of Proposition 13 and the continuing
reduction in the size of the District, it is recognized that sometime in the future the
District will have to consider dissolution and have its responsibilities assumed by
other government agency or agencies, and
WHEREAS, the City of National City is willing to continue to provide
interim fire protection and emergency medical service to the areas of the District
lying north of the Sweetwater River channel and any areas east of I-805 as shown on
Exhibit "A", pending final resolution of the dissolution question and possible
annexation of that area in an acceptable manner to the City of National City, and
NOW, THEREFORE, IT IS MUTUALLY AGREED BY AND BETWEEN THE
PARTIES HERETO AS FOLLOWS:
1. GENERAL CONDITIONS. The City of National City agrees to provide
fire protection and emergency medical service to the area previously described (and
as shown in Exhibit "A") of the Lower Sweetwater Fire Protection District, and
furthermore the City agrees to include that area in the City's paramedic service
area.
2. TERM. This agreement will commence on January 1, 1986 and
continue in full force and effect until December 31, 1986 or until such time
as the District may be dissolved or unless terminated prior thereto as provided
herein.
3. TERMINATION. This agreement may be terminated by any of the
parties hereto upon delivery of a written notice of intent to terminate from the
initiating governing body of the other governing body. Said termination shall become
effective three (3) months from the receipt of notice or at such other data as may
be mutually agreed upon by the parties.
4. DISTRICT PROPERTY AND EQUIPMENT. The District will continue to
own, maintain, and have complete control of its equipment and property during the
term of this agreement.

5. DISTRICT EMPLOYEE. The District employee will continue to be
treated as an employee of the National City Fire Department and shall perform for
the duration of this agreement under the direction of the National City Fire Chief.
Accumulated vacation, sick leave and other benefits shall be preserved from the date
of the March 1 5 , 1982 agreement. Personnel compensation shall be based on that
certain agreement between the National City Firefighters Association and the City
entitled "Memoranda of Understanding", July 1, 1984 - June 30, 1987.
The District employee, during the term of this agreement, shall be
considered as an employee of the National City Fire Department, provided however,
if this agreement is terminated as provided herein, the City may, but is not required
to, retain said District employee.
If, during the term of this agreement, the District is dissolved and said
area is annexed to National City, it is agreed that the District employee will be
integrated into the National City Fire Department at the existing salary and rank
held during the period that contractual protection was furnished. All prior service
and benefits accrued prior to and during the contractual period shall be retained by
the District employee.
6. PAYMENTS. The District will make payments as described in Schedule
"B" to the City of National City quarterly, on the first working day of January,
April,. July and October.
7. SERVICE. The City of National City will provide fire protection to the
area of the District previously described as continguous to its boundaries. The City
shall maintain an engine company at its fire station at 2401 E. 24th Street, National
City.
In addition, fire prevention services such as code enforcement, plan checks,
and weed abatement as well as fire investigation and secretarial services shall not be
included in the quarterly base payment but rather shall be included as separate and
additional costs payable quarterly. Such costs shall not exceed $1,000 each quarter
without prior approval from District Board.
8. IMPLEMENTATION. The City and the District shall exercise their best
efforts to implement the terms and conditions of this agreement; provided, however,
it is the understanding of the City of National City and the District that this
agreement provides an interim solution for providing fire and emergency medical
services to the District and an ongoing effort will be made to dissolve the District
and incorporate said area into the corporate boundaries of National City.

RESOLUTION AUTHORIZING EXECUTION OF A 90 DAY
EXTENSION OF THE EXISTING AGREEMENT BETWEEN
THE LOWER SWEETWATER FIRE PROTECTION DISTRICT
AND THE CITY OF NATIONAL CTTY TO PROVIDE FIRE
AND MEDICAL PROTECTION
On the motion of Director Thomas , seconded by Director
Spencer , the following resolution is adopted:
BE IT RESOLVED by the Governing Board of the Lower Sweetwater
Fire Protection District that Vice -Chairman Spencer is authorized and
directed to execute that certain agreement between the Lower Sweetwater
Fire Protection District and the City of National City to insure continued
fire protection and emergency medical services for the Lower Sweetwater
Fire Protection District.
PASSED AND ADOPTED by the Governing Board of the Lower
Sweetwater Fire Protection District, County of San Diego, State of
California, this 12th day of December , 1985 by the following vote:

The Board of Directors for the Lower Sweetwater Fire
Protection District, at their meeting of November 14, 1985,
voted unanimously to approve the proposed resolution extending
the contract by 90 days.
