HomeMy WebLinkAboutCC RESO 14,828RESOLUTION NO. 14,828 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA DENYING WITHOUT PREJUDICE AN APPLICATION FOR CONDITIONAL USE PERMIT TO ALLOW THE SALE OF BEER AND WINE (TYPE 41 LIQUOR LICENSE) AS AN INCIDENTAL USE TO A RESTAURANT ON PROPERTY LOCATED AT 543 HIGHLAND AVENUE. (APPLICANT: GEORGE URY AND NAZARIO MADRIEM) CASE FILE NO. CUP 1985-20 WHEREAS, this action is taken pursuant to all applicable procedures required by State and City law; and. WHEREAS. the entire contents of Case File No. CUP 1985-20. maintained by the City. are attached to and made part hereof, by reference; and. WHEREAS, the action recited herein is found to be essential for the preservation of public health, safety and general welfare; and, WHEREAS, testimony and evidence presented to the City Council at a properly noticed public hearing failed to support a finding that the proposed use is deemed essential and desirable to the public convenience and welfare at the location proposed due to the fact that there is an over concentration of establishments selling alcoholic beverages in the vicinity. NOW. THEREFORE, BE IT RESOLVED that the application is denied for the reason that there is an over concentration of establishments selling alcoholic beverages in the vicinity. BE IT FURTHER RESOLVED that the application is denied without prejudice. PASSED and ADOPTED this 17th day of December. 985.
