HomeMy WebLinkAboutCC RESO 14,261RESOLUTION NO. 14,261 RESOLUTION DETERMINING AND DECLARING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY OF THE CITY OF NATIONAL CITY REQUIRE THE CONSTRUCTION, OPERATION AND MAINTENANCE OF A PUBLIC STREET ACROSS CERTAIN DESCRIBED LAND IN THE CITY OF NATIONAL CITY, COUNTY OF SAN DIEGO, STATE OF CALIFORNIA, AND THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY DEMAND THE ACQUISITION OF PARTIAL TRUST DEED INTEREST TO SAID PROPERTY TO BE USED BY SAID CITY FOR SAID PURPOSE; AND DECLARING THE INTENTION OF THE CITY OF NATIONAL CITY TO ACQUIRE SAID PROPERTY UNDER EMINENT DOMAIN PROCEEDINGS: COMMENCE AN ACTION IN THE SUPERIOR COURT OF THE STATE OF CALIFORNIA IN AND FOR THE COUNTY OF SAN DIEGO FOR THE PURPOSE OF ACQUIRING SAID PROPERTY (Euclid Avenue Extension, Plaza Boulevard to 16th Street) BE IT RESOLVED by the City Council of the City of National City as follows: SECTION 1: That the public interest, convenience and necessity of the City of National City and the inhabitants thereof require the construction, operation and maintenance of a public street across that certain parcel of real property located in the City of National City, County of San Diego, State of California, and fully described in Exhibit "A" here- to, which said Exhibit is attached hereto and by this reference incorporated herein and made a part hereof as though set forth in full; SECTION 2: That the public interest, convenience, and necessity of said City and inhabitants hereof demand the acquisition and taking of partial trust deed interest to said property for the construction, operation and maintenance of the aforesaid public streets as described in the attached legal description as Exhibit "A"; all lying within the City of National City, County of San Diego, State of California; SECTION 3: That the property to be condemned is fully described in Exhibit "A" attached hereto and incorpo- rated by reference in Section 1 above; SECTION 4: That the taking and acquiring by said City of the property described in Exhibit "A" hereto is deemed necessary for the construction, operation and maintenance of said public street by the City of National City and the in- habitants thereof for municipal purposes; that such uses are public uses and that for such public uses it is necessary that the City of National City condemn and acquire the property hereinabove described; that the property hereinabove described is to be used for the construction, operation and maintenance of the said public street; SECTION 5: That the City Attorney of the City of National City be and he is hereby authorized and directed to commence an action in the Superior Court of the State of California in and for the County of San Diego, in the name and on behalf of the City of National City against all owners and claimants of the above -described property rights for the purposes of condemning and acquiring said property rights for the use of said City. PASSED and ADOPTED this 28th day of February, 1984. ATTEST: That portion of the Westerly Half of the Northeasterly Quarter of the Northwesterly Quarter of the Southwesterly Quarter of Quarter Section 106 of the Rancho de la Nacion, in the City of National City, County of San Diego, State of California, according to Map thereof No. 166, made by Morrill, filed in the office of the County Recorder, May 11; 1869, described as follows: Beginning at the Southeasterly corner of the Northeasterly Quarter of the Northwesterly uarter of the Southwesterly Quarter of Quarter Section 106; thence South 71°36'57" West long the Southerly line of said parcel, 194.65 feet to the True Point of Beginning being ie center of a 36 foot radius curve; thence North 15°10'24" East, 36 feet to a point on nat 36 foot radius curve concave Southerly; thence Northwesterly, Westerly and Southwesterlyi .long said curve through a central angle of 67°06'54" for a distance of 42.17 feet to a radial line bearing South 51°56'30" East; thence along said line 36 feet to the center of said 36 foot radius curve, being the True Point of Beginning. Excepting therefrom that portion lying Southerly of a line 30 feet Northerly and parallel to the Southerly line of said Northeasterly Quarter. EXHIBIT "A"
