HomeMy WebLinkAboutCC RESO 14,296RESOLUTION NO. 14,296 RESOLUTION ORDERING TEMPORARY CLOSURE OF "D" AVENUE BETWEEN 12TH AND 16TH STREET AND AUTHORIZING THE DIRECTOR OF PARKS AND RECREATION TO EXECUTE A REPAIR AGREEMENT BY AND BETWEEN THE CITY OF NATIONAL CITY AND THE NATIONAL CITY LION'S CLUB WHEREAS, the City Council has previously permitted the Lions Club of National City to conduct a community Fourth of July celebration in Kimball Park, National City, California; and WHEREAS, the Department of Parks and Recreation has determined that use of a portion of "D" Avenue between 12th Street and l6th Street is necessary to prevent damage to the facilities of Kimball Park; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of National City hereby order the closure of "D" Avenue between 12th Street and l6th Street from 12:00 p.m. June 29, 1984 to 12:00 a.m. July 5, 1984, or such lesser period of time as the City Manager of National City may determine. BE IT FURTHER RESOLVED by the City Council of the City of National City, California, that the Director of Parks and Recreation is authorized to execute a Repair Agreement by and between the City of National City and the National City Lions Club regarding damages and repair to same. PASSED and ADOPTED this 17th day of April, 1984. 447,, ATTEST: / CITY CLER REPAIR AGREEMENT This Agreement is between the City of National City, herein- after "City", and the National City Lions Club, hereinafter "Lions". WHEREAS, the Lions desire to hold their annual Fourth of July celebration on City property, known as Kimball Park; and WHEREAS, the City has in the past, when such celebration was held, determined damage was caused to the park; and WHEREAS, the Lions have expressed a willingness to assume the responsibility for repair or reimbursement to the City for damage caused by their celebration; NOW, THEREFORE, the parties hereto agree as follows: 1. The Lions hereby agree to reimburse City for all damages caused by the set-up, staging, presentation, and clean-up of their 1984 Fourth of July celebration in Kimball Park, National City, California, or, cause to be repaired all damages caused by same. 2. The City hereby agrees to allow the Lions to use its property, Kimball Park, in a reasonable and legal manner for their 1984 Fourth of July celebration. 3. The repairs the Lions will by this Agreement effect, will include, but are not limited to: cracked or broken sidewalks or curbs, broken irrigation heads, valves, valve boxes, lines, etc.; damaged or uprooted trees, shrubs, lawn or groundcover. 4. Repairs or replacements to the irrigation system(s) shall be commenced by the Lions within two (2) days by licensed contractor and completed as soon as possible. 5. Replacement trees shall be of fifteen (15) gallon size; replacement shrubs shall be of five (5) gallon size. 6. The City may establish rules and regulations for the use of its property for the Fourth of July celebration and the Lions shall take all steps necessary to enforce all said rules and regulations. 7. City's representative (either City Manager or the Director of Parks and Recreation) may issue verbal or written instructions regarding the safe and reasonable use of the property, and Lions shall take all steps necessary to comply with all such instructions. 8. The City reserves the right to disapprove the selection of any private contractor proposed to do work on City property. 9. The party signing for the Lions hereby declares he is authorized to sign and bind the Lions to the terms of this Agreement. Any misrepresentation, intentional or not, will subject said party to personal liability for the obligations of the Lions under this Agreement.
