RESOLUTION NO. 14,335
RESOLUTION DIRECTING THE TEMPORARY CLOSING
OF A PORTION OF NATIONAL CITY BOULEVARD
(CALTRANS and ERRECA'S INCORPORATED)
WHEREAS, CALTRANS has asked permission to close, temporarily, a portion
of a public street for a public purpose; and
WHEREAS, State of California Vehicle Code, Division II, Rules of the Road,
Article 3, Local Regulation, Section Z1101, Regulation of Highway (e), provides
a means for granting said purpose; and
WHEREAS, the public inconvenience on National City Boulevard, and on
Highland Avenue, and on Hoover Avenue, and on 30th Street, will be offset by
the public safety experienced during the construction period and mitigated by
the future safety and convenience of a better road and drainage system in
National City; and
WHEREAS, the said portions of National City Boulevard is within the work
area of the Freeway Agreement Boundary, and CALTRANS has issued a contract
to do the work within the said Freeway Agreement area to ERRECA'S
Incorporated, and CALTRANS and ERRECA'S have jointly asked for and are
aware of certain conditions to be imposed;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
National City, California, that National City Boulevard, between the southerly
line of 33rd Street and the northerly line of 35th Street shall be closed
temporarlily oat various times and days from on or about 15 June 1984 to on or
about November 1, 1984, and that said closing shall be between the hours of
6:00 a.m. and 2:30 p.m. daily, and, that said ERRECA'S will use regulations as
shown in State of California, Department of Transportation Standard
Specifications, January '81, for cleaning and dust control; for repair of and
restoring of existing pavement and street facilities; and
BE IT FURTHER RESOLVED that said closing will not become effective
until signs giving notice of said closing are posted on National City Boulevard at
30th Street, at 33rd Street, at 35th Street, at "C" Avenue, and, on Hoover
Avenue at 30th Street; and
BE IT FURTHER RESOLVED that the recipient of this temporary closing
shall notify the City of National City Engineering Department, the police
Department and the Fire Department of the commencement of such closing, the
temporary non-use of said right to temporary closing, and the re -use of said
temporary closing, 48 hours in advance of each initial use and tempoary non-use
and when the need for said closing does not exist; and
BE IT FURTHER RESOLVED that the said recipient of this temporary
closing carry bonds and insurance in any contract with CALTRANS, covering
National City facilities and interests, as if said contracts were with the City of
National City.
