HomeMy WebLinkAboutCC RESO 14,360RESOLUTION NO. 14,360 RESOLUTION GIVING NOTICE OF INTENTION TO VACATE AND CLOSE PORTIONS OF SWEETWATER ROAD, NORTH SIDE, BETWEEN GROVE STREET AND PROSPECT STREET (SC 2-84) The City Council of the City of National City, California, hereby declares its intention to vacate and close, pursuant to the provisions of Part 3 of Division 9 of the Streets and Highways Code of California, portions of Sweetwater Road, north side, between Grove Street and Prospect Street, situated in the City of National City, County of San Diego, State of California, more particularly described in Exhibit "A" attached hereto and incorporated herein as though set forth in full. Further, that the City of National City will reserve and except from the foregoing vacation the permanent easement as more particularly described hereafter: Reserving and excepting to the City of National City the right, easement and privilege of placing, constructing, repairing, replacing, maintaining, using, and operating public utilities of any kind or nature, including, but not limited to sewer, water, and drainage, and all necessary and proper fixtures and equipment for the use in connection therewith, through, over, under, upon, along and across all the portions or parts of the hereinafter described easement. Also reserving and excepting from the vacation, subject and subordinate to the aforementioned easement to the City of National City, the permanent right at any time, or from time to time, pursuant to any franchise or renewal thereof, for and on behalf of the San Diego Gas & Electric Company, the Pacific Telephone and Telegraph Company and the Sweetwater Authority, or any other utility company operating under a municipal or state franchise with the City of National City, to construct, maintain, operate, replace, remove, and renew lines of pipe, conduits, cables, wires, poles, and other related structures, including the necessary use of equipment and fixtures from the operation of gas pipe lines, telegraphic, and telephone lines, and for the transportation or distribution of electric energy, through, over, under, upon, along and across all portions of the hereinafter described easement: r'^ The easements and rights hereinabove reserved and excepted shall include the right of ingress thereto and egress therefrom, together with the right to maintain the said easement free and clear of any excavation or fills, the erection or construction of any building or other structures, the planting of any tree or trees thereon, or the drilling or digging of any well or wells thereon, together with the right to otherwise protect from all hazards the operation and use of any right hereby reserved. Upon written permission of the City and of any public utility listed heretofore, the owners of the underlying fee may utilize the above described parcel of land for structures, approved plantings, the installation of privately owned pipelines, and/or other approved usages. The easement reserved herein is in, under, over, upon, along and across that portion of Sweetwater Road, north side, between Grove Street and Prospect Street, more particularly described in Exhibit "A" attached hereto and incorporated herein as though set forth in full. Time for hearing any and all persons interested in or objecting to the proposed vacation is hereby set for 7:00 p.m., August 14, 1984, in the City Council Chambers in the Civic Center in the City of National City, California. The City Engineer of the City of National City, California, is hereby directed to post notice of the passage of this Resolution and the time and place of hearing in accordance with law. ATTEST: C---/"----.t— CITY CLERK( E3 18IT ",d! i (x.-Z-s4) LEGAL DESCRIPTION FOR THE VACATION OF A PORTION OF SWEETWATER ROAD Those portions of Lots 1, 52, 53, 79 and vacated Grove Street of Lincoln Acres in the City of National City and the County of San Diego, State of California, according to map thereof No. 1740, filed in the office of the County Recorder of said County, TOGETHER with that portion of 40 acre Lot 2 of Quarter Section 134 of Rancho de la Nacion according to map thereof No. 166, filed in the office of the County Recorder of said San Diego County, lying Northerly of a line, which is 44.00 feet Northerly of and parallel with the centerline of San Diego County Road Survey No. 778-2, filed in the office of the County Surveyor of said County. The beginning of said line being at a position 30.00 feet Easterly of the centerline of Grove Street as shown on said Road Survey No. 778-2 and terminating on the East at a point of intersection with the Southwesterly prolongation of that certain course shown as 'North 52'10'52' East 35.37 feet" on a detail of Prospect Street on Sheet 2 of 5 sheets of San Diego County Road Survey No. 1323, filed in the office o•f the County Surveyor of said County.
