RESOLUTION APPROVING PLANNED DEVELOPMENT PERMIT TO
ALLOW A SHOPPING CENTER AT THE SOUTHEAST CORNER
OF PLAZA BOULEVARD AND GROVE STREET
The City Council of the City of National City, California, does hereby
find, determine, order, and resolve as follows:
WHEREAS, at a regular meeting of the Planning Commission of the
City of National City, California, held on June 4, 1984, said Commission
adopted Resolution No. 17-84 approving Planned Development Permit to allow
development of a shopping center consisting of two fast-food drive-thru
restaurants (4,400 square feet) and 26,600 square feet of retail and restaurant
space on 2.76 acres at the southeast corner of Plaza Boulevard and Grove
Street, subject to certain conditions of approval; and
WHEREAS, testimony and evidence presented to the City Council at
their July 10, 1984 meeting support the following findings:
1. The site for the proposed use is adequate in size and shape;
2. The site has sufficient access to streets;
3. The proposed use will not have an adverse effect upon adjacent
or abutting properties;
4. The proposed use is deemed essential and desireable to the public
convenience and welfare.
NOW, THEREFORE, BE IT RESOLVED that this application is approved
subject to the following conditions:
1. A cooperative agreement shall be executed between the City and
the Grove Plaza developer providing for their payment of fifty
(50) percent of the total cost of a traffic signal light at the
intersection of Plaza Boulevard and Grove Street, and at 805
northbound off -ramps. Said traffic signal light shall be installed
prior to final inspection and/or issuance of any certificate of
occupancy.
2. Right turn only sign shall be provided for traffic exiting the
shopping center onto Plaza Boulevard.
3. A grading plan, including on -site drainage structures shall be
submitted concurrently with building plans for issuance of a
building permit.
4. All cut slopes shall be 2:1 minimum unless evidence is supplied
by a licensed soils consultant that a steeper slope is safe and
stable.
5. Fourteenth Street adjacent to the project site shall be widened
to 40 foot curb to curb and curb, gutter, sidewalk and paving
installed.
6. Construct a 48" RCP in 14th Street to connect the existing pipes
per City Engineer's drawing.
7. A 6" VCP is required to convey the sanitary sewer from 13th
Street along the east boundary of the property line to 10" VCP
flowing along 14th Street. Reconnect from old 10" main in
property to the east to the 14th Street main.
8. A water system and fire hydrant shall be constructed in Grove
Street per City Engineer's plan prior to final acceptance of the
project.
9. For each restaurant, floor plans clearly indicating seating
arrangement and statement regarding number of employees shall
be submitted concurrently with building plans for issuance of a
building permit.
10. A pedestrian walkway shall be provided between the public
sidewalk on Plaza Boulevard and on Grove Street to each retail
sales space and restaurant.
11. Parking facility shall be effectively screened from Plaza
Boulevard and Grove Street. Mounded landscaping and/or
combination decorative masonry wall and landscape required.
12. Parking spaces provided for the handicapped shall be in
accordance with State regulations and be located adjacent to
each building. In addition to pavement marking, an eye level,
State approved symbol shall be mounted at the forward end of
all such spaces.
13. No sign shall be permitted on the 14th Street frontage of this
project.
14. Screen wall at property line on 14th Street shall not exceed a
height of six (6) feet above official property line grade.
15. All trash enclosures visible from a public street shall be
constructed of decorative masonry.
16. Landscaped slope adjacent to east property line of project site
shall incorporate jute matting to minimize possibility of erosion.
The developer shall enter into covenants and agreements required
by the City to ensure permanent landscape maintenance.
17. Only two (2) pole -mounted or free standing signs shall be
permitted.
18. Maximum height of any pole -mounted or free standing sign shall
be fifty (50) feet to the top of the sign.
19. Roof signs shall be prohibited.
20. Exit doors on the south and east sides of the main building shall
be subject to Department of Building and Safety approval.
21. Except as otherwise provided herein, development shall be in
substantial compliance with the plans prepared by Brown/Leary,
Architecture and Planning dated February 17, 1984, and identified
as National City Planning Department Exhibit "A", Case File No.
CUP-1984-4/PD-2-84.
22. Before this Planned Development Permit shall become effective,
the applicant shall file a written statement with the Planning
Department acknowledging and accepting all conditions imposed
upon the approval of this permit.
23. Fireflow required is 4000 GPM for five hours at minimum PSI.

24. In order to provide this flow, provide the following:
a) In addition to public hydrant at Plaza and Grove (southeast
corner) provide additional on -site hydrant in parking lot.
b) Dead end main on 14th Street shall be tied in.
c) In lieu of #A and #B sprinkler entire complex (buildings C,
D, and E).
25. In lieu of #24 provide area separation walls (2 hour minimum,
every 8000 square feet, through roof) for buildings C, D, and E
(fireflow will be 2500 GPM for 4 hours at 20 PSI).
26. Hours of operation of the fast-food, drive-thru restaurants shall
be limited to no later than 11:00 p.m. on week nights and 12:00
midnight on Friday and Saturday with no deliveries prior to 7:00
a.m.
