RESOLUTION NO. 14,441
RESOLUTION APPROVING PLANNED DEVELOPMENT PERMIT TO
ALLOW DEVELOPMENT OF A COMMERCIAL SHOPPING
CENTER HAVING A TOTAL FLOOR AREA OF 126,697 SQUARE
FEET, ON PROPERTY LOCATED ON THE SOUTH SIDE OF
PLAZA BOULEVARD, IMMEDIATELY EAST OF "L" AVENUE EXTENSION

The City Council of the City of National City, California, does hereby
find, determine, order, and resolve as follows:
WHEREAS, at a regular meeting of the Planning Commission of the
City of National City, California, held on August 20, 1984, said Commission
adopted Resolution No. 39-84 approving Planned Development Permit to allow
development of a commercial shopping center having a total floor area of
126,697 square feet on property located on the south side of Plaza Boulevard,
immediately east of "L" Avenue extension, subject to certain conditions of
approval; and
WHEREAS, testimony and evidence presented to the City Council at
their September 11, 1984 meeting support the following findings:
1. The site for the proposed use is adequate in size and shape;
2. The site has sufficient access to streets;
3. The proposed use will not have an adverse effect upon adjacent
or abutting properties;
4. The proposed use is deemed essential and desireable to the public
convenience and welfare.
NOW, THEREFORE, BE IT RESOLVED that this application is approved
subject to the following conditions:
1. Parking lot pavement shall be at least 2-1/2 inch asphaltic
concrete Type C2-AR-400 over 7 inch thick crushed aggregate
base.
2. Where buildings are shown located over existing sewer easement,
existing sewer lines shall be encased according to Drawing No.
118-S-B, and clean -outs approved as to design by the City
Engineer, shall be provided at each end of the building.
3. All retaining walls shall be constructed of decorative materials.
All crib walls shall have integrated landscape and irrigation
approved by the Director of Planning.
4. A safety barrier, approved as to type and height by the City
Engineer shall be installed adjacent to the sidewalk on "L"
Avenue extension.
5. Fast food restaurants shall be limited to the "Plaza Terrace"
area and shall not exceed 40 percent of the total floor area.
6. The trash enclosure on Plaza Boulevard frontage shall be
relocated and the curb cut on Plaza Boulevard serving only the
trash enclosure shall be eliminated. This area shall then be
landscaped.
7. Access driveway on Plaza Boulevard, east of "L" Avenue
extension, shall be limited to right turn -in and right turn -out. A
"pork -chop" island to limit traffic flow, approved by the City
Engineer, shall be installed at the intersection of this driveway
with Plaza Boulevard.
8. Within 60-days of the date of approval of the City Council
resolution for this planned Development Permit, the irrigation
system on east slope of the property shall be completed and put
in working order; the necessary water meter shall be installed.
9. Wrought iron gates, with chain and lock system approved by the
City Fire Chief, shall be installed along the property line at the
west end of 14th Street to limit project access to emergency
vehicles only. Gates may be constructed of other materials of
equal quality approved by the Director of Planning.
10. The roof and exterior finish of all kiosks shall be designed to be
architecturally compatible with that of the main buildings.
a) A maximum of six (6) permanent kiosks may be allowed
subject to "site plan review" and issuance of a building
permit.
b) Each kiosk shall be provided with adequate security lighting.
11. A separate grading and drainage plan with retaining wall designs,
and soils report supporting the grading design shall be submitted
to and approved by the City Engineer prior to issuance of a
building permit.
12. A detailed landscape/irrigation plan for the entire project shall
be prepared by a qualified landscape architect and submitted
concurrently with building plans for issuance of a building permit.
Said irrigation system shall include automatic irrigation controls.
Areas of landscape adjacent to Plaza Boulevard and "L" Avenue
shall be mounded.
13. Except as otherwise noted, development shall be in accordance
with plans prepared by Edward Oremen, AIA, dated April 11,
1984, with site plan revised August 9, 1984, and identified as
National City Planning Department Exhibit "A", Case File No.
PD-4-84.
14. Before this planned development permit shall become effective,
the applicant shall file with the Planning Department, an
acknowledgment, in writing, accepting all conditions imposed upon
the approval of this permit.
15. Prior to issuance of a building permit, the property owner shall
file an agreement to be recorded as a covenant running with the
land, not to protest a 1911 Improvement Act for the
improvement of 14th Street and "M" Avenue, where adjacent to
this property.
16. Developer shall pay 60 to 75 percent of the City Engineer's
estimate cost for a traffic signal light at the intersection of "L"
Avenue extension and Plaza Boulevard, prior to issuance of a
building permit. The signal shall be fully operational prior to
any occupancy permits being issued.
17. Prior to issuance of a building permit, the property owner shall
record an agreement, approved by the City Attorney as to form
and content, with the San Diego County recorder, providing that

the property owner accepts all responsibility for the repair and
liability of sewer and storm drain pipes where located under
buildings.
