RESOLUTION NO. 14,452 RESOLUTION DENYING CONDITIONAL USE PERMIT TO ALLOW THE SALE OF ALCOHOLIC BEVERAGES AS AN INCIDENTAL USE (Type 20 Off -Sale Beer and Wine Liquor License) IN CONJUNCTION WITH A PROPOSED CONVENIENCE STORE WITH DELI AT 3035 EAST 8TH STREET (APPLICANT: MIKE TAJRAN) C UP-1984-16 The City Council of the City of National City does hereby find, determine, order and resolve as follows: WHEREAS, at a regular meeting of the Planning Commission of the City of National City, California, held on August 6, 1984, said commission adopted Resolution No. 32-84, denying application for Conditional Use Permit No. 1984-16 to allow the sale of alcoholic beverages (Type 20 Off -Sale Beer and Wine Liquor License) in conjunction with a proposed convenience market with deli on property located at 3035 E. 8th Street, based on a finding that the proposed use will have an adverse effect upon adjacent or abutting properties; and, WHEREAS, an appeal of Planning Commission decision was filed with the City Council and a public hearing on appeal was conducted by the City Council; and, WHEREAS, evidence and testimony presented to the City Council at the meeting of September 11, 1984, failed to support the following findings: 1. That the proposed use will not have an adverse effect upon adjacent or abutting properties. 2. That the proposed use is deemed essential and desireable to the public convenience or welfare. NOW, THEREFORE, BE IT RESOLVED that this application for conditional use permit is denied for the reason that: ATTEST: The proposed use will have adverse effect upon adjacent residential properties; and, the proposed use is not deemed essential and desireable to the public convenience or welfare.
