RESOLUTION DENYING AN APPLICATION FOR ZONE
VARIANCE TO ALLOW A REDUCTION IN THE NUMBER
OF OFF-STREET PARKING SPACES REQUIRED IN
CONJUNCTION WITH A MEDICAL OFFICE ON PROPERTY
LOCATED AT 305-315 EAST 12TH STREET
(Applicant: Gabriel Arce)
(Z-3-83)
The City Council of the City of National City, California, does hereby
find, determine, order, and resolve as follows:
WHEREAS, at a regular meeting of the Planning Commission of the
City of National City, California, held on April 18, 1983, said commission
adopted Resolution 16-83, denying application for zone variance to allow a
reduction in the number of off-street parking spaces required in conjunction with
a proposed out -patient mental health counseling center on property located at
305-315 East 12th Street, based on a finding that evidence and testimony
presented to this Commission at the public hearing failed to support a finding
that would justify the granting of zone variance in accordance with California
Government Code Section 65906; and
WHEREAS, an appeal of Planning Commission decision was filed with
the City Council and a public hearing on appeal was conducted by the City
Council; and
WHEREAS, evidence and testimony presented to the City Council at
the meeting of November 13, 1984, failed to support a finding that the granting
of this zone variance would not have an adverse effect upon adjacent or
abutting properties;
NOW, THEREFORE, BE IT RESOLVED that this application for zone
variance is denied for the reason that the granting of this zone variance would
have an adverse effect upon adjacent and abutting properties.
PASSED and ADOPTED this 20th day of November, 1984.
