HomeMy WebLinkAboutCC RESO 14,500RESOLUTION NO. 14,500 RESOLUTION APPROVING AN APPLICATION FOR CONDITIONAL USE PERMIT TO ALLOW THE OPERATION OF A GASOLINE STATION ON PROPERTY LOCATED AT 430 EAST EIGHTH STREET (Applicant: Joseph Shamai) (C UP-1984-24) The City Council of the City of National City, California, does hereby find, determine, order, and resolve as follows: WHEREAS, at a regular meeting of the Planning Commission of the City of National City, California, held on October 15, 1984, said commission adopted Resolution No. 52-84, approving application for conditional use permit to allow the operation of a gasoline station on property located at 430 East 8th Street subject to certain conditions of approval; and WHEREAS, an appeal of Planning Commission decision was filed with the City Council and a public hearing on appeal was conducted by the City Council; and WHEREAS, evidence and testimony presented to the City Council at the meeting of November 27, 1984, support the following findings: 1. The site for the proposed use is adequate in size and shape. 2. That the site has sufficient access to streets. 3. That the proposed use will not have an adverse effect upon adjacent or abutting properties. 4. That the proposed use is deemed essential and desireable to the public convenience and welfare. NOW, THEREFORE, BE IT RESOLVED that this application for Conditional Use Permit No. 1984-24 is approved subject to the following conditions: 1. Free air, water and restroom facilities shall be made available for service station customers. 2. All portions of the parkways adjacent to not included within the driveways and/or landscaped and irrigated. 3. Plans shall indicate secondary containment for tanks and monitoring devices per Sher Bill. 7. Upon approval from the Health Department, plans shall be submitted to the City Fire Department for approval and permit. 8. Installation of new tanks or re -use of existing tanks shall not take place without approval from both the Health Department and National City Fire Department. 9. Before this conditional use permit shall become effective, the applicant shall file a written statement with the Planning Department, acknowledging and accepting all conditions imposed upon the approval of this permit. 10. Adequate on -site lighting shall be provided. An on -site lighting plan shall be submitted to and approved by the Planning Department prior to installation. 11. Disposal of waste petroleum products shall be in accordance with Department of Building and Safety, and City Fire Department requirements. 12. Vehicles located on these premises pending parts and/or repair, shall be parked so as not to obstruct the on -site vehicular circulation of gasoline customers. 13. Before this conditional use permit shall become effective, the following violations of the City's land use regulations shall be corrected: (a) Oil water draining into alley from area located immediately south of Woods Auto Repair. (b) No masonry enclosure for trash receptacle. (c) Two (2) wheel trailers of the type used to transport a car, stored adjacent to "E" Avenue frontage. 14. There shall be no outdoor auto -body repair, sanding or painting on these premises. PASSED and ADOPTED this 4th day of December, 1984. ea", MAYOR ATTEST: r-�
