HomeMy WebLinkAboutCC RESO 14,504RESOLUTION NO. 14,504 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA AUTHORIZING AND APPROVING A GRANT AGREEMENT FOR ECONOMIC DEVELOPMENT WITH THE STATE OF CALIFORNIA, DEPARTMENT OF HOUSING & COMMUNITY DEVELOPMENT WHEREAS, the City Council, by adoption of Resolution No. 14,394 on August 7, 1984 authorized and approved an application to the State of California for an economic development grant in the amount of $400,000 to be used for the curing of a subsidence problem at the southeast corner of 30th Street and National City Blvd. by removing trashy fill, replacing with clean fill and surcharging the area to make it suitable for the construction of a new car dealership by Brown Motors pursuant to a contract for sale of land between the Community Development Commission of the City of National City and Brown Motors executed October 21, 1982; and WHEREAS, the State of California, by letter dated November 14, 1984 has approved said application and has offered a grant agreement in the amount of $400,000 for said work which must, under the terms of the agreement be completed and construction of a new car dealership by Brown Motors begun within 18 months of execution of the agreement by the State; and WHEREAS, the City and the Community Development Commission will be able to fulfill the terms and conditions of the grant agreement. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City that the Mayor is authorized to execute, on behalf of the City of National City, California, a Grant Agreement with the State of California, Department of Housing & Community Development (Grant Number 83-EDBG-018) dated October 1, 1984 for $400,000 with a grant period of October 1, 1984 to September 30, 1986 for site preparation to permit development of a new car dealership at the southeast corner of 30th Street and National City Blvd., and the City Clerk is authorized to attest thereto. In accepting this grant award the Grantee agrees to comply with the terms and conditions of this agreement and all attachments hereto, the representations contained in the Grantee's application (hereinafter "the Application"), which is hereby incorporated by reference as if set forth in full, and the requirements of the authorities cited above. 1. Pursuant to 25 Cal. Admin. Code Section 7056(b)(1), as a condition of receiving - any CDBG funds, the Grantee must have submitted to the Department and adopted a housing element which meets the substantive requirements of Article 10.6 (commencing with Section 65580) of the Government Code. In addition, prior to the drawdown of any CDBG funds, the Grantee shall submit a certification, on forms provided by the Department, that the Grantee has adopted a housing element which was in compliance with the substantive requirements of Article 10. at the time of adoption. Upon submittal of this certification, the Grantee may draw down both administrative and program implementation funds. As a condition of continued receipt of grant funds during development or operation of the project(s) applied for, the Grantee must submit to the Department and adopt a revision to the housing element in accordance with the requirements and time frames established by Gov. Code Section 65588(b) (AB 3618, Ch. 208, Stats. of 1984, effective June 20, 1984). On or before July 1, 1985, Grantee shall submit a certification, on forms provided by the Department, that the Grantee has adopted a revised housing element which complies with the substantive requirements of Article 10.6. Failure to submit a draft revised housing element to the Department, adopt the re- vised element in accordance with the time frames contained in Government Code 65588(b), and/or provide such certification on or before this date may result in cancellation or delay in receipt of the undrawn balance of the grant award. 2. Prior to the drawdown of funds, the Grantee shall submit evidence of com- pliance with NEPA and CEQA. 3. The hiring plan of Brown Motors shall include a provision that special emphasis be given to recruiting and hiring residents of the area, minori- ties and women. 4. Brown Motors shall emphasize the use of vendors and suppliers that are small businesses, women and minority owned and operated. 5. In the event Brown Motors does not begin construction of their auto dealership on the improved site within 18 months of the date that this Grant Agreement is signed and accepted by the Department of Housing and Community Development,the Grantee expressly agrees to repay this grant in full to the Department of Housing and Community Development within 30 days after that date.
