RESOLUTION GRANTING A PLANNED DEVELOPMENT PERMIT
PURSUANT TO ORDINANCE 1077
(To construct a McDonald's Restaurant on property
located within the 1300 block of Grove Street,
west side: PD-1-82)
The City Council of the City of National City,
California, does hereby find, determine, order, and resolve
as follows:
1. At a regular meeting of the City Planning Commission
held on May 24, 1982, said Commission adopted a recommendation
that the owner of real property within the 1300 block of Grove
Street, be denied a Planned Development Permit.
2. That the City Council has received the recommenda-
tion of the Planning Commission, and after full and complete
consideration of said recommendation hereby grants a Planned
Development Permit to allow development of a McDonald's
Restaurant within the 1300 block of Grove Street, west side,
subject to the following conditions:
a. Adequate exterior security lighting shall
be provided for all parking and building areas during
darkness, regardless of business hours.
b. The business proprietors

c. Stop signs shall be provided at all driveways
with access to a public street.
d. All exterior mechanical equipment, including
electrical and gas meters, shall be architecturally screened
from view, and electrical transformers shall be either under-
ground or architecturally screened. Noise baffling shall be

e. Pedestrian access (walkway) shall be provided
between the proposed restaurant and public sidewalk on Grove
Street.
f. An encroachment permit shall be approved by
the City Council prior to any work being done on the northerly
80 feet of property to be improved.
g. A detailed landscape/irrigation plan for the
entire project shall be prepared by a qualified landscape architect
and submitted to and approved by the Planning Department prior
to issuance of a building permit.
(1) Said landscape/irrigation plan shall
include all adjoining parkways.
(2) Automatic irrigation controls shall be
provided.
h. Final subdivision map and reciprocal use access
easements shall be recorded prior to issuance of building permit.
i. A minimum 5 foot high decorative wall with
dense screen -type landscaping on both sides shall be constructed
along the entire 14th Street northerly to a point in line with
the northerly face of the McDonald's building. All such walls
to be setback at least 10 feet from the property line on 14th
and 5 feet on Grove.

(1) Adjacent shrubbery shall be maintained
at a height at least equal to the height
of the wall.
Conditional use permit authorizing enclosure
of Paradise Creek Drainage Channel within this area of develop-
ment shall be approved and in effect prior to issuance of building
permit.
k. Development shall be in accordance with submitted
plan except as noted herein.
1. Development plans submitted for issuance of
a building permit shall be subject to the provisions of Chapter
18.128 National City Municipal Code (Site Plan Review).
m. Trash enclosure on the proposed Parcel 2 shall
be architecturally screened.
(1) One additional trash enclosure shall be
provided on the proposed Parcel 1 and
shall be subject to architectural
screening.

n. Additional vehicle lane, twelve (12) feet
in width, shall be constructed between the Interstate 805
Northbound off -ramp and Grove Street as a widening of Plaza
Boulevard. This lane shall be appropriately signed and/or
striped to provide for traffic control. Plans signed by a
Registered Civil or Traffic Engineer will be required as evi-
dence that the design concept is acceptable.
o. Any public improvements not now existing or
damaged and requiring replacement along Plaza Boulevard, Grove
Street and 14th Street, shall be installed in accordance with
current City of National City Municipal Code provisions.
p. Within a period not to exceed 30 days from the
effective date of resolution granting planned development permit
No. 1-82, the applicant shall file a written statement with the
Planning Department, acknowledging and accepting all conditions
imposed upon the granting of this permit.
FAILURE TO FILE SUCH WRITTEN STATEMENT WITHIN
THE TIME PERIOD SPECIFIED SHALL AUTOMATICALLY
TERMINATE THE PLANNED DEVELOPMENT PERMIT

The cul-de-sac shown on the City Engineer's
sketch presented to the City Council on July 13, 1982, shall be
dedicated and improved to City standards by the applicant in
this case.
r. The unnamed commercial structure shown on
the site plan be deleted at this time and be brought back at a
later date when a specific use is known.
s. Hours of operation shall be limited to 11:00 PM
on week nights and 12:00 Midnight on Friday and Saturday, with
no deliveries prior to 7:00 AM.
t. No driveways shall enter onto 14th Street.
u. Stree.t lights shall be provided at the south
end of the cul-de-sac and at the intersection of Plaza Boulevard
and Grove Street.

v. Applicant shall be responsible for daily
pick up of litter attributed to this use on the entire site
and within a radius of one city block.
w. Noise levels exceeding the standards pre-
scribed by National City Municipal Code Title 12 will be
grounds for an administrative order by the City Council limit-
("" ing the hours of "drive thru" business to as early as
10:00 p.m., daily.
x. The City Council reserves authority to waive
or modify condition number "n" herein to allow lesser widening
upon finding that the Grove Street cul-de-sac will diminish
traffic movement conflicts along Plaza Boulevard.
