RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NATIONAL CITY, CALIFORNIA, AUTHORIZING
THE CITY ENGINEER TO ENTER INTO AN ACQUISITION ESCROW
FOR PROPERTY AT 2519 EAST 13TH STREET (ROBERTS)
PER ESCROW NUMBER 56791-S DATED MAY 11, 1983
(Land Title Insurance Company)
WHEREAS, the extension of Euclid Avenue from
Plaza Boulevard to 16th Street will require removal of a
portion of 13th Street; and
WHEREAS, a partial taking of 162 square feet
will be required from premises at 2519 East 13th Street in
order to provide a turn -around cul-de-sac on the east side
of 13th Street,
NOW, THEREFORE, BE IT RESOLVED by the City
Council of the City of National City that the City
Engineer is hereby authorized to enter into an Acquisition
Escrow for property at 2519 East 13th Street in the City
of National City, County of San Diego, State of
California, for the acquisition in fee of all real
property described in Exhibit "A" attached hereto.
A copy of said escrow instructions are on file
in the Office of the City Clerk and reference is made
herein for all particulars contained therein.
PASSED AND ADOPTED this 7th day of June, 1983.

9. In the event of a failure of a performance or condition to be complied with in a stated period of time, or on or before a stated
10. date, or in the event these instructions are not complied with on or before June 13, 1983
11. either party may give you a written demand to cancel. otherwise complete this escrow as soon as possible. In the event such
12. demand is signed by less than all of the parties hereto, you are to withhold all documents and proceeds until ten days after
13. you have mailed a copy of said demand to the non -signing parties at the respective addresses shown herein. Upon receipt of said
14. demand, the parties shall, immediately after demand by you, reimburse you for services rendered to date; and you are hereby
15. given a lien upon all documents, moneys and securities herein deposited until you have been so compensated.
16. Your knowledge of matters affecting the property, provided such facts do not prevent compliance with these
17. instructions, does not create any liability or duty in addition to your responsibility under these instructions.
18. No notice, demand or change of instructions. except a demand for cancellation made in accordance with
19. the foregoing paragraph, shall be of any effect in this escrow unless given in writing by all parties affected
20. thereby.
21. Proceeds of this escrow may be disbursed by your check payable to the parties as their names are signed hereon,
22. and your checks and documents may be mailed to the addresses set forth in these instructions.
23. You are instructed to furnish to any broker hereunder or any lender, or anyone acting on behalf of the lender, any information
24. concerning this escrow, including among other things certified copies of all escrow instructions and any amendments there-
25. to and copies of final closing statements upon request of such broker or lender.

Escrow holder is instructed to obtain from Federal National Mortgage Association,
beneficiary under the deed of trust encumbering subject property a partial reconveyance
for the portion being released to the City. In the event said beneficiary places a
demand on the escrow for the funds being paid herein in part or in full, escrow is
instructed to pay said funds as required to the beneficiary at the close of escrow.

That portion of the Westerly Half of the Northeasterly Quarter of the Northwesterly Quarter
of the Southwesterly Quarter of Quarter Section 106 of the Rancho de la Nacion, in the City
of National City, County of San Diego, State of California, according to Map thereof No. 166,
made by Morrill, filed in the office of the County Recorder, May 11, 1869, described as
follows:
Beginning at the Southeasterly corner of the Northeasterly Quarter of the Northwesterly
Quarter of the Southwesterly Quarter of Quarter Section 106; thence South 71°36'57" West
along the Southerly line of said parcel, 194.65 feet to the True Point of Beginning being
the center of a 36 foot radius curve; thence North 15°10'24" East, 36 feet to a point on
that 36 foot radius curve concave Southerly; thence Northwesterly, Westerly and Southwesterly
along said curve through a central angle of 67°06'54" for a distance of 42.17 feet to a
radial line bearing South 51°56'30" East; thence along said line 36 feet to the center of
said 36 foot radius curve, being the True Point of Beginning. Excepting therefrom that
portion lying Southerly of a line 30 feet Northerly and parallel to the Southerly line of
said Northeasterly Quarter.
