RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NATIONAL CITY, CALIFORNIA, DIRECTING
THE TEMPORARY CLOSING OF A PORTION OF 33RD STREET
IN THE CITY OF NATIONAL CITY
(Bannister Steel Company)
WHEREAS, BANNISTER STEEL has asked permission to
use a public street for a private purpose; and
WHEREAS, said private purpose will result in a gain
in revenue to the City of National City; and
WHEREAS, State of California Vehicle Code, Division
11, Rules of the Road, Article 3, Local Regulation, Section
21101, Regulation of Highways (e), provides a means for
granting said private use; and
WHEREAS, the said portion of 33rd Street is within a
Freeway Agreement boundary; and
WHEREAS, the California Department of Transportation
is in agreement, as to said Freeway Agreement, and to the
requested private use with certain conditions imposed;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of National City, California, that 33rd Street, as
dedicated on Map No. 5792 thereof, westerly of the southerly
prolongation of the west line of Hoover Avenue (Coolidge
Avenue) as shown on said Map 5792 be temporarily closed; and
BE IT FURTHER RESOLVED that said temporary closing
will not become effective until signs giving notice of said
closing are posted on said 33rd Street at the east entrance to
said closing; and
BE IT FURTHER RESOLVED that the recipient of this
temporary closing will agree in writing to vacate said
right-of-way of 33rd Street within ten (10) days of a written
notice from the California Department of Transportation that
said department wishes to occupy said right-of-way; and
BE IT FURTHER RESOLVED that the recipient of this
temporary closing post with the City Clerk a Faithful
Performance Bond in the amount of Five Thousand Dollars
($5,000.00), said bond to be in effect prior to posting of
this temporary closing and to remain in full force until
thirty (30) days after the recipient of the temporary closing
has vacated the street right-of-way of 33rd Street.
PASSED AND ADOPTED this 12th day of July, 1983.
