HomeMy WebLinkAboutCC RESO 13,953RESOLUTION NO. 13,953 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA CALLING ON THE DISTRICT ATTORNEY TO INVESTIGATE ELECTION LAW VIOLATIONS WHEREAS, the City of National City has conducted a Special Municipal Election to determine the will of the people to proceed with a downtown redevelopment project, known as Proposition W; and WHEREAS, the City Clerk of the City of National City has determined that opponents of Proposition W have apparently committed violations of the laws relating to the conduct of municipal elections; and WHEREAS, the City Council of National City has called upon the District Attorney of San Diego County to investigate the alleged wrongdoing and prosecute any violations of the law which he finds to have been committed; and WHEREAS, in the past the District Attorney of San Diego County has been eager to investigate and publicly report upon alleged misconduct of public officials in this City; and WHEREAS, no report of investigative activity or the conclusions reached by said District Attorney relating to the complaints of the City Clerk concerning apparent municipal election law violations has yet been made, NOW, THEREFORE, BE IT RESOLVED by the City Council that: 1. Edwin Miller, District Attorney of the County of San Diego, is called upon to investigate the complaints of the City Clerk of the City of National City regarding possible violations of the election laws occurring in the recent Special Municipal Election of this City concerning Proposition W. 2. The District Attorney of San Diego County is called upon to proceed with said investigation with the same vigor and enthusiasm he has exhibited in investigating the alleged misconduct of public officials of this City and to publicly report on his investigation as soon as it is completed. 3. The City Clerk is authorized and directed to transmit a copy of this resolution to the District Attorney of San Diego County. PASSED AND ADOPTED this llth day of January, 1983. ATTEST: -2-
