HomeMy WebLinkAboutCC RESO 14,204poison bme RESOLUTION NO. 14,204 RESOLUTION AUTHORIZING THE FIRE DEPARTMENT TO ENTER INTO AN AUTOMATIC AID AGREEMENT BETWEEN THE CITY OF NATIONAL CITY AND THE FIRE PROTECTION DISTRICT OF BONITA/SUNNYSIDE BE IT RESOLVED, that the City of National City desires to enter into an agreement with the Bonita/Sunnyside Fire Portection District, to eliminate the boundaries between the City and the District, for fire protection purposes. This agreement will allow the nearest fire unit to respond to an emergency incident regardless of jurisdictional boundries. BE IT FURTHER RESOLVED, that said contract shall begin January 1, 1984. NOW THEREFORE, the City Council of the City of National City hereby directs the City Manager to execute an agreement between the Bonita/Sunnyside Fire Protection District and the City of National City. ATTEST: 01 j‘ AGWEEMENT THIS AGREEMENT is made by THE CITY OF NATIONAL CITY, a municipal corporation, and THE BONITA/SUNNYSIDE FIRE PROTECTION DISTRICT, herein called "Parties". RECITALS A. The Agencies of National City and Bonita Fire District main- tain, organized and equipped Fire Departments charged with the duty of fire related emergency responses within the limits of said City and District. B. Investigation has disclosed it would be to the benefit of each party that the services of each of their Fire Departments be, in some circumstances, extended outside of the limits of each party; and into the limits of the other party. C. The parties desire that in some circumstances the Fire Depart meets of the other party will respond to fire related emergency responc (to include Medical Aid Responses) within its limits. NOW, THEREFORE, in consideration of the recitals and the mutual obligations of the parties as herein expressed, the City of National City and Fire Protection District of Bonita/Sunnyside agree as follows 1. The parties of this agreement agree to respond to fire relate emergency responses outside of their geographical limitations, and int the geographical limitations of the other party in accordance with the following terms and conditions. 2. Political boundaries between the co-signers of this agreement shall be dropped. All plans which deal with fire related emergency responses shall adhere as closely as possible to the nearest unit con- cept, without regard to political jurisdiction. The signing of this agreement represents each party's request of the other party for • /Oh assistance in responding to fire related emergency responses which occur geographically closer to the other party's fire suppression units. 3. The Chiefs of the parties' Fire Departments are authorized to execute supplementary agreements regarding operational procedures and planning as are necessary to implement this agreement. An oper- ational committee consisting of the Chiefs or their designate(s) of the Fire Departments of the Parties shall implement this agreement. Each party shall furnish the other in writing the name and rank of all participating officers. 4. The duties of Incident Commander shall be assumed by the senior ranking fire official from a participating agency who is presen at the scene of the incident, without regard to the jurisdiction in which the incident occurs. There shall be an orderly transfer of command when an officer of equal or higher rank from the jurisdiction in which the incident occurs arrives at the scene, if that officer see to assume Incident Command. 5. National City agrees to indemnify and save Bonita/Sunnyside and its agents and employees harmless from any and all liability, claims, damages or injuries to any person, including injury to Nationa City's employees and all claims which arise from or are connected with National City's performance or failure to perform the obligations of this agreement, or are caused or claimed to be caused by the acts of National City, National City's agents or employees; and all expenses c investigating and defending against same. Bonita/Sunnyside agrees to indemnify and save National City and its agents and employees harmless from any and all liability, claims, damages or injuries to any person, including injury to Bonita/Sunnysi, employees and all claims which arise from or are connected with Bonit. -2- Sunnyside's.performance or failure to perform the obligations of this agreement, or are caused or claimed to be caused by the acts of Bonit< Sunnyside, Bonita/Sunnyside's agents or employees; and all expenses o. investigating and defending against same. Nothing in this agreement is intended by the parties to diminish waive, or otherwise affect the privileges and immunities conferred up( the parties by operation of law. 6. Each party to this agreement shell cover its employees' Work( Compensation liability without cost to the other party, and each depa: ment shall payroll its own personnel without cost to the other depart? 7. Each party shall be fully responsible for all repairs, maint' nance and upkeep, including gas, oil, lubrication, parts replacement, and repair of casualty damage. of its own equipment used pursuant to this agreement while its equipment is used outside of its political boundaries. However, during prolonged suppression activities, the requesting agency shall replenish fuel and needed and provide minor maintenance of fire suppression equipment. B. The requesting department shall provide the responding de- partment's personnel with necessary food and refreshments. Any chemical agents used for fire suppression by the responding departmen shall be replenished by the requesting department. 9. The parties to this agreement shall provide each responding apparatus with a crew of a minimum of three trained fire fighters including a full-time paid commanding officer, or certified acting officer, and a full complement of equipment according to the National Fire Protection Association standards as stated in Pamphlet 1901. 10. The assurance of automatic aid to the parties shall constit the sole consideration for the performance of this agreement. It is understood and agreed that no money payments shall be made between tt -3- i departments, that no charges shall be assessed by any department against any other department except as expressly provided in this agreement. A 11. Nothing in this agreement shall limit either party from participating in separate agreements with other fire jurisdictions and shall have no effect pon the existing San Diego County Mutual Aid Agreement. Should any party withdraw for any reason from the existing County Mutual Aid Agreement, this agreement is automatically terminated upon the effective date of such withdrawal from mutual aid. 12. In order to standardize fire fighting procedures among the signatories of this agreement and to ensure efficient fire suppression operations at any incident where automatic aid is being rendered, the parties to this agreement agree to establish a system of cross-trainin for their fire fighting personnel. This agreement may be terminated by either party upon giving the other jurisdiction's Fire Chief written notice of intent to terminate by January 1, with such termination to become effective the following. July 1. IN WITNESS WHEREOF, this agreement is executed by the City of National City acting by and through its City Manager, pursuant to Resolution No. /4 2,044 authorizing such execution, and by the Bonita/ Sunnyside Fire Protection District by and through its Board Chairpersc pursuant to authorization of the Bonita/Sunnyside Fire Protection District Board of Directors.
