HomeMy WebLinkAboutCC RESO 13,879RESOLUTION NO. 13,879 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA AFFIRMING AND RATIFYING CERTAIN CERTIFICATIONS AND FINDINGS IN CONNECTION WITH A SUPPLEMENT TO THE ENVIRONMENTAL IMPACT STATE- MENT, NATIONAL CITY DOWNTOWN REDEVELOPMENT PROJECT WHEREAS, MSA, Inc., Environmental Consultants, San Diego, earlier prepared a draft Environmental Impact Report (EIR) and Environmental Impact Statement (EIS), herein called "Environmental Impact Statement" for the National City Downtown Redevelopment Project and the Community Development Commission held a public hearing thereon on August 25, 1981; and WHEREAS, a Final Environmental Impact Statement was prepared and the Community Development Commission, by adoption of Resolution No. 81-53(NCDRP) on November 17, 1981, made certain certifications and findings in connection with said Final Environmental Impact Statement; and WHEREAS, the City Council, after joint public hearing with the Community Development Commission on the Redevelopment Plan and Relocation Program for the National City Downtown Redevelopment Project on November 17, 1981 certified that it had considered the Final EIR/EIS for the Project as prepared by MSA, Inc., San Diego, and adopted Ordinance No. 1762 approving the Redevelopment Plan and the Feasibility of Relocation for the Redevelopment Project; and WHEREAS, certain owners of real property and of businesses located primarily at the intersection of 8th Street and National City Blvd. filed lawsuits against the Project which have resulted in the need of supplementary environmental analysis and information; and WHEREAS, MSA, Inc., at the direction of the Community Development Commission's Executive Director and with the assistance of Community Development Commission and City staff has prepared a Supplement to the Environmental Impact Statement which addresses displacement of adult entertainment and related businesses, National City Downtown Redevelopment Project, consistent with the Court's direction; and WHEREAS, the Community Development Commission held a public hearing on said Supplement on June 22, 1982, has considered the written comments to the Supplement and the written and oral testimony at the public hearing, has prepared responses to all comments and testimony received, and has included such testimony and responses thereto in the Final Supplement; and WHEREAS, the Final Supplement was distributed to the Members of the City Council, each has read the Supplement and is fully aware of its contents, and the City Council desires to affirm and ratify certain certifications and findings earlier made by the Community Development Commission in connection with said Final Supplement; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City, California that it affirms and ratifies the following certifications and findings earlier made by the Community Development Commission of the City of National City in connection with the Final Supplement to the Environmental Impact Statement, Displacement of Adult Entertainment and Related Businesses, National City Downtown Redevelop- ment Project: (3) The project will require displacement of a maximum of 29 businesses and this effect is considered to be insignificant with mitigation. The combination of redevelopment and City ordinances will eliminate any concentration of adult entertainment and related businesses within National City. No significant adverse impacts will occur. The combination of nearby City or County ordinances, as may be applicable, private land use controls, and economic conditions will prevent any concentrated movement of adult entertainment and related businesses from the City of National City to surrounding communities. No significant adverse impacts will occur. (4) With the existing and proposed Redevelopment Project controls, those of the City of National City, and of all nearby cities and county areas, the positive and beneficial consequences of the Project far outweigh any potential adverse environmental consequences.
