HomeMy WebLinkAboutCC RESO 13,896RESOLUTION NO. 13,896 RESOLUTION ACCEPTING A REQUEST FOR DEFERRAL OF STREET IMPROVEMENTS AND A COVENANT RUNNING WITH THE LAND (1014 COOLIDGE - BEAUCHAMP) BE IT RESOLVED by the City Council of the City o f National City that a Covenant granted to the City of National City by ALTON B. and ARLENE R. BEAUCHAMP affecting property at 1014 Coolidge Avenue, National City, is hereby accepted and the City Clerk is directed to record the same. ATTEST: PASSED AND ADOPTED this 14th day of September, 1982. CITY CLERi COVENANT RUNNING WITH THE LAND This COVENANT is made by ALTON B. AND ARLENE R. BEAUCHAMP hereinafter referred to as "OWNER". WHEREAS OWNER is the owner of the that certain real property locatec in the City of National City, County of San Oiego, State of California, described as follows: Lots 19, 20, 21, 22 of Block 118, National City, Map No. 348 WHEREAS, said owner desires to be excused from the legal requirements to install the following improvements: At 1014 Coolidge Avenue: 1. Install a pedestrian ramp at Intersection of Coolidge & Plaza. 2. Insta11!2,000 square feet of asphalt concrete (3") and base (8"). 3. 2,000 square feet of Seal and Sand over asphalt concrete. 4. Excavation and grading associated with the above. NOW, THEREFORE, in consideration for the granting of a deferral to install said improve- ments by the City Council of the City of National City, said owner covenants for themselves and their heirs, successors, assigns, executors and administrators as follows: 1. The owner willinot protest the installation of any of the required improvements unde 1911 Improvement Act program whether initiated by the property owners or the City. 2. The owner will; install said improvements in conjunction with an overall improvement program of the area whether initiated by the property owners or the City. 3. The owner will install the required improvements within 30 (Thirty) days of a writte; demand to do so by the City Engineer. 4. Owner will remain liable to repair street sections installed by him, in front of'he subject property upon reasonable demand of the City Engineer. Page 1 of 2 (Fort.
