RESOLUTION ADOPTING POLICY FOR CITY ASSISTJ,NCE
RELATING TO COMPLETION OF WORK UNDER
HOMEOWNERS PUBLIC IMPROVEMENT PERMIT
WHEREAS, Chapter 13.04 of the National City
Municipal Code sets forth the requirements for homeowner
installations of curb, driveway, and sidewalk improvements;
and
WHEREAS, homeowners are required to assume
extensive responsibility for all aspects of the work, including
provision for public safety during construction, repairs to
existing public improvements damaged during the installation,
and clean up;
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of National City does hereby find and determine
that this scope of responsibility may create a hardship on some
homeowners attempting to improve their property warranting the
adoption of the following policy of City Assistance on
Homeowner Public Improvement Projects:
1. The determination of hardship shall be made by
the City Council upon the request of property
owner for assistance either orally at a regular
meeting of the City Council or in writing. The
property owner should demonstrate to Council's
satisfaction that a hardship exists.
2. Work effort expended by City forces should be
limited to approximately two (2) manhours. Such
work is not to include any portion of the public
improvement project itself, but be limited to
such items as patching adjacent pavement, repair
to adjoining curb, gutter or sidewalk, or
installing transitions between old and new
improvements, all within the public
right-of-way.
3. The City, its officers or agents, shall incur no
liability for any work performed, it being
undertaken in the best interest of the City to
assist the property owner in a hardship
situation with work for which the owner is
normally responsible.
