RESOLUTION ACCEPTING A REQUEST FOR DEFERRAL
OF STREET IMPROVEMENTS AND A COVENANT RUNNING
WITH THE LAND
(2921 E. 18th. Street)
(MIGUEL & FRANCES S. RAMIREZ'
BE IT RESOLVED by the City Council of the City
of National City that a Covenant granted to the City of
National City by MIGUEL and FRANCES S. RAMIREZ, affecting
the property at 2921 E. 18th Street, National City, is
hereby accepted and the City Clerk is directed to record
the same.
PASSED AND ADOPTED this 20th day of April, 1982.
COVENANT RUNNING WITH THE LAND
This COVENANT is made by MIGUEL & FRANCES S. RAMIREZ
hereinafter
referred to as "OWNER". WHEREAS OWNER is the owner of the that certain real property located
in the City of National City, County of San Diego, State of California, described as follows:
Lot 237 of LINCOLN ACRES ANNEX NO. 2, according to map thereof No. 1748 filed in
Office of the County Recorder of San Diego County, State of California, February
7, 1923.
WHEREAS, said owner desires to be excused from the legal requirements to install the
following improvements:
In 17th Street: Permanent improvements consisting of curb & gutter, asphaltic
concrete paving, aggregate base and grading, and also,
In the easement for Drainage and Sanitary Sewer: Permanent sanitary sewer and
underground drainage conduit.
Reference City of National City Engineering Drawings 628-0 through.634-D in-
clusive.
NOW., THEREFORE, in consideration for the granting of a deferral to install said improve-
ments by the City Council of the City of National City, said owner covenants for
themselves and their heirs, successors, assigns, executors and
administrators as follows:
1. The owner will not protest the installation of any of the required improvements under
1911 Improvement Act program whether initiated by the property owners or the City.
2. The owner will install said improvements in conjunction with an overall improvement
program of the area whether initiated by the property owners or the City.
3. The owner will install the required improvements within 30 (Thirty) days of a written
demand to do so by the City Engineer.
