HomeMy WebLinkAboutCC RESO 13,800RESOLUTION NO. 13,800 RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT BETWEEN CITY OF NATIONAL CITY AND THE NAVY FOR FUNDS TO REPLACE CITY SEWER IN WILSON AVENUE BE IT RESOLVED by the City Council of the City of National City that the City Manager is authorized and directed to execute that certain agreement between the City of National City and the Navy for funds to re- place City sewer in Wilson Avenue. PASSED AND ADOPTED this llth day of May, 1982. ATTEST: MEMO OF Understanding Between City of National City and Area ROICC, U. S. Navy Background: Navy contract N62474-79-C-5778, Ship Wastewater Collection Ashore (P-I91) at the Naval Station, San Diego, CA, included approximately 3000 L.F. of 21 inch VCP sewer line in the streets of National City with a POL to the Metro sewer line on Wilson Ave. The 21" 7CP line closely parellelled the city's 10" VCP sewer line on Wilson Ave. During excavations, the 10" VCP line failed at numerous stations. The contractor repaired all failures. At one point in time, the contractor requested and received permission from the city to "hi -line" the 10" VCP line and relay it after completion of work on. Wilson Ave_ This plan was initiated, but quickly abandoned when the contractor changed job superintendents. It is the city's contention that the numerous failures, plus the close proximity of the excavation to the 10" 7CP line certainly affected the alignment of the 10" VCP line and compaction underneath the line possibly leading to future settlement of the line beyond contract warranty. The city therefore requested the Navy to direct the contractor to relay the line. The ROICC basically agreed.with the city on its concern about future problem, but no contract provision was available to direct the correction of "suspected" or "future".damage to adjacent utilities. It was therefore agreed that the Navy would reimburse the city for this cost for the city to relay the line at a future date. In addition, the city agreed to repair the traffic loop damaged by the contractor at Harbor Drive and replace the AC pavi-g im th concrete swale at Wilson Ave. and Civic Center Drive. AGREEMENT It is the intent of this agreement that the.City of National City shall be re- imbursed for work within the context as described above, but should damage to City facilities occur which is reasonably traceable to poor workmanship or ma- terials in the Navy contract work, then repair to City facilities shall be under- taken against the usual Navy construction contract warranty. It is therefore, agreed that Navy will provide $50,000 to the City of National City for any damage to the 10" Vitrified Clay Pipe sewer line on Wilson Avenue from stations 1+00 to 5+70, NAVFAC drawing 6084112, repairing the traffic signal actuating loop on Civic Center Drive, eastbound lane westerly of Harbor Drive, and replacing the Portland cement concrete swale at Wilson and Civic Center Dr. This payment relieves Navy of any and all costs of repair to damage to any of those facilities specified herein as a result of work done pursuant to the ori- ginal work on Navy Contract N-62474-79-C-5778 between the months of March 1981 and October 1981, except that any damage or facility not specifically mentioned in this agreement shall rev* -fa subject to any remedy available to the parties hereto had this agreement not been entered into, and in accordance with the in- tent noted above.
