HomeMy WebLinkAboutCC RESO 13,616RESOLUTION NO. 13,616 RESOLUTION APPROVING TENTATIVE SUBDIVISION MAP TO ALLOW THE DIVISION OF PLAZA BONITA SHOPPING CENTER INTO 13 LOTS ON PROPERTY LOCATED BETWEEN SWEETWATER ROAD, PLAZA BONITA ROAD AND BONITA MESA ROAD. (Applicant: Rogoway/Borkovetz Associates) (S-3-81) BE IT RESOLVED by the City Council of the City of National City that the tentative map to allow the division of Plaza Bonita Shopping Center into 13 lots on property located between Sweetwater Road, Plaza Bonita Road and Bonita Mesa Road. (Applicant: Rogoway/Borkovetz Associates) Case File No. S-3-81 be approved subject to the following conditions: 1. The site for th.e proposed use is adequate in size and shape. 2. That th.e site has sufficient access to streets. 3. That th.e proposed use will not have an ad- verse effect upon adjacent or abutting properties. 4. That the proposed use is deemed essential and desirable to the public convenience and welfare. NOW, THEREFORE, BE IT RESOLVED THAT this applica- tion is approved subject to th.e following conditions: 1. Reimbursement by May Centers to the Parking Authority of the City of National City for the two water meters, vaults, piping, and by-passes which solely serve the Regional Shopping Center ($47,800). 2. Reimbursement by May Centers to the Parking Authority of the City of National City for the sewerage metering station which solely serves the Shopping Center ($32,000). 3. Payment by May Centers to the City of National City of its public works inspection fee. Pursuant to Sec- tion 17.24.010 of the National City Municipal Code, May Centers Inc., shall pay the city $175,000 for its costs prior to approval of the final subdivisions map. An item- ized estimate of the improvement cost is the basis for the Engineer to compute the deposits for checking of plans, maps, inspections, and out-of-pocket costs by the City. The City Engineer estimates the amount of this cost, as a cash de- posit to be $175,000.00, which shall be deposited in a special account at the City Treasurer as per Resolution 13,279. Any surplus funds over and above the City's out-of- pocket costs to date and the Parking Authority's out-of- pocket cost to date shall be invested by the City Treasurer at the highest yeild obtainable and such surplus funds and accrued interest shall be returned by the City to May Centers, Inc., not later than January 1, 1982. 4. Prior to th.e recording of a Final Map, a copy of the Covenants, Conditions, and Restrictions shall be filed with and approved by the City Attorney of the City of National City: The Covenants, Conditions, and Restrictions shall: (a) Clearly specify a level of maintenance of all landscaped areas and suitable measures to guarantee compliance therewith by the owners. (b) Provide that th.e City may enter the pro- perty and perform necessary maintenance work and place a tax lien on the property to cover the cost thereof. Cc) Provide for the maintenance of and con- tinued unobstructed access to fire protection equipment and life safety systems, fire lanes, internal walkways, and appli- ances per city Ordinance 1591 and Uniform Fire Code Sections 13.206, 13.207, 13.208, (al through. (e) and 13.202 (a) and (_b) as required by the City of National City Fire Department. (d) Clearly specify a level of architectural quality, including colors, textures, signs, etc., to be ex- pected and suitable measures to guarantee compliance therewith by individual owners. - 2 5. The Final Subdivision map shall contain cer- tificates, acknowledgements and complete boundary information all as required by the Subdivision Map Act and City of National City Municipal Code. Additional specific requirements are listed below. 6. Definite ingress and egress shall be from tentative parcels 1, 2, 3, 5, 9, 10, 12, and 13 to tentative parcels 4, 6, 7, 8, and 11, where common boundaries exist. 7. Defnite ingress and egress shall be between tentative parcels 1, 2, 3, 5, 9, 10, 12, and 13 where common boundaries exist. 8. Proposed Plaza Bonita Road shall be dedicated on the Final boundaries shall, where appropriate, these roads. 9.
