Venture) BE IT RESOLVED by the City Council of the City of National City, California, as follows: Pursuant to Resolution No. 7083, the City Clerk is hereby ordered to execute a Certificate of Acceptance and to record the following instrument conveying an in- terest in or easement upon real estate to the City of National City: EASEMENT from SECURITY TITLE INSURANCE COMPANY, dated 4/1/81 Engr. No. 5355. EASEMENT from NATIONAL MEAT PACKERS, INC., dated 10/18/81, Engr. No. 5357. EASEMENT from C.T.P. VENTURE, dated 5/7/81, Engr. No. 5356. PASSED AND ADOPTED this 27th day of October, 1981. ATTEST: Recording requested by and when recorded mail to City of National City 1243 National Ciy Boulevard National City, California 92050 TEMPORARY EASEMENT DEED FOR VALUABLE CONSIDERATION, a receipt of.which is hereby acknowledged, NATIONAL MEAT PACKERS, INC. hereby GRANT(S) and conveys to the CITY OF NATIONAL CITY, a municipal corporation, and its successors and assigns, a temporary easement and right of way to enter upon and pass and repass, over and along the land conveyed herein, by said CITY OF NATIONAL CITY, its officers, agents and employees, and by persons under contract, and their employees, herein- after collectively referred to as "CITY", whenever and wherever necessary for the purpose of roadway reconstruction, renewing, inspecting, enlarging, and using said roadway. Said rights shall include the right and privilege to place and operate any and all machinery on said land which the Grantee herein or any agent or contractor employed by said Grantee deems necessary for the construction of said roadway. It shall also include the right to remove any landscaping, structures, or other improvements within the temporary easement area which prevent the full use of said area for the purposes set forth herein. Said easement shall lie in, under, over and across that certain real property situated in the CITY OF NATIONAL CITY, County of San Diego, State of California, and more particularly described in Exhibit "A" to this Deed and such description by this reference is made a part hereof as though set forth at length. A plat showing the location of such easement is attached hereto as Exhibit "B". It is understood that the above -described temporary easement is to be made available to the CITY at any time during the period from July 1, 1981 until July 1, 1982 or until a notice of completion of such reconstruction work is recorded, whichever occurs first. It is further understood that the temporary easement and right of way above described shall be acquired subject to therights of the Grantor(s), its successors and assigns, to use the land within the boundary lines of such easements and rights of way to the extent compatible with the full and free exercise of -said easements and right of way by the CITY OF NATIONAL CITY, provided, however, that it is understood and agreed by the parties hereto that Grantor and Grantor's successors or assigns shall not increase or decrease or permit to be increased or decreased, at any time during the term of this temporary easement, the existing ground elevations of the described right of way, existing at the time this document is executed, without the prior written consent of the Grantee; THIS IS TO CERTIFY THAT THE INTEREST I REAL PROPERTY VEYED Y THE DEED OR GRANT DATED„ FROM ro THE CITY OF NATIONAL CITY, A POLITICAL CORPORATION AND/ - OR GOVERNMENT AGENCY, IS HEREBY ACCEPTED BY ORDER OF THE CITY COUNCIL ON-- 2.L17( AND THE GRANTEE CONSENTS TO THE RECORDATION THEREOF BY ITS DULY AUT ORIZED OFFICER. Upon completion of the road reconstruction work, all improvements shall be restored to the same general condition as existed prior to the beginnning of said construction work, except that the real property herein shown may be graded and compacted to provide new grade elevations. 2. CITY shall indemnify the undersigned against and hold the undersigned harmless from any loss of or damage to any property, and liability therefor, or injury or death of any person whomsoever, and liability therefor, proxi- mately caused in whole or in part by negligence of CITY, its contractors, agents, employees, servants and others for which CITY, its contractors, agents, employees, servants and others acting for or on behalf of CITY are liable without fault in the exercise of the rights herein granted. 3. CITY's Resident Engineer shall have preconstruction meeting(s) between Ralph Grahl, City Engineer, and Fred Cameron of National Meat Packers, Inc. prior to commencement of each of the stages of construction described below. 4. All station numbers referenced below are shown on improvement plan drawings by the City of National City and on Exhibits "C" and "D" attached hereto. The stages of construction shall be as follows: Stage I - The Southerly one-half of 24th Street will be reconstructed from Station 1+70 Easterly, as shown on Exhibit "D" hereto. Tentative work schedule is 15 days. Stage II - The Southerly one-half of 24th Street will be reconstructed from Station 1+70aWesterly, as shown on Exhibit "D" hereto. Tentative work schedule is 15 days. Stage III - (a) Fill, compaction and temporary surface to be placed on Wilson Avenue together with driveway apron located between Stations 10+42.3 and 10+28.3 (as shown on Exhibit "C" hereto) and the northerly half of 24th Street from its westerly point of intersection with Wilson Avenue to its easterly point of intersection with Wilson Avenue. Grantee shall cause this work to be accomplished in a 48 hour period from Friday noon to Monday at 6:00 a.m. (b) The north one-half of 24th Street to be reconstructed together with an alternative drive- way apron, serving Grantor's business, 28 feet wide with a centerline Station of 2+56 as shown on Exhibit "C" hereto. (c) The reconstruction of existing driveway apron and inlet structure located approximately at Station 11+23 as shown on Exhibit "C" hereto. -2- M Htra EA : A A (d) The reconstruction of existing driveway apron located between Stations 10+42.3 and 10+28.3, as shown on Exhibit "C" hereto. - (e) Permanent surface to be placed on Wilson Avenue. Tentative work schedule is 15 days for (b), (c), (d) and (e) above. 5. Excluding the 48 hour period described in (a) above, and such other 48 hour periods as may be necessary for Stage III (c), (d) and (e) and agreed on by the parties under the provisions of paragraph 3. above, Grantee shall provide Grantor with access from Wilson Avenue via 24th Street at all other times for the duration of this easement, allowing Grantor to proceed with business. 6. It is further understood and agreed that upon completion of the work of constructing a driveway approach in the location herein above mentioned and described on Exhibit "C" hereto as "New 28' Ac. D.W.", said approach shall be considered as an encroachment, under permit, upon CITY's street and is to be maintained, repaired and operated as such by OWNER in accordance with and subject to the laws, rules and regulations of the CITY. 7. It is mutually understood and agreed between the parties hereto that on the completion of the reconstruction described in Stage III (c) and (d) above, Grantee shall, at Grantor's election and within 30 days of notice thereof, restore that portion of Grantor's property affected by said driveway to its original condition. This Temporary Easement and the provisions contained therein shall be binding upon the heirs, successors, administrators, personal representatives and assigns of the parties hereto.
