RESOLUTION APPROVING TENTATIVE SUBDIVISION
MAP - CANYON VIEW CONDOMINIUMS, 2550-52
RACHAEL AVENUE. (S-2-79)
BE IT RESOLVED by the City Council of the City of
National City that the tentative map for Canyon View
Condominiums, 2550-52 Rachael Avenue be approved subject
to the following conditions:
1. That the map indicate all survey and mathematical
information, monuments, bearings and distances, and ties to
existing monuments used to establish the subdivision boundary.
2. A grading plan, including drainage facilities
and appurtenances and retaining walls, referenced to National
City datum, per Ordinance 803, Chapter 70 of the Uniform
Building Code and all applicable sections of the Land Use Code
shall be approved by the City Engineer prior to the issuance
of a Final Map. The grading plan shall show an on -site
drainage system capable of collecting slope runoff and
nuisance water and channeling it into an underground storm
drain system without the water traversing project streets.
3. Toe ditches and ditches constructed at the top
of slopes for erosion prevention purposes shall be a minimum
of 3 feet in width with two -block high wall construction on
the down slope side. All ditches shall be constructed with
Portland Cement Concrete.
4. The developer shall submit hydrology, hydraulic
and storm drain calculations with the project grading plan.
5. The proposed rip -rap energy dissipator at the
southerly end of the project shall be constructed per San
Diego Regional Standard Drawing No. D-41. The size of the
project storm drain shall be governed by the required
hydrology, hydraulic and storm drain calculations. (See
Condition 4)
6. Letter of permission for any off -site work on
private property, said work set out in detail, shall be
filed with. the City Engineer;
7. An improvement agreement, with security attached
approved by the City Attorney, with a timely completion date,
covering the herein stipulated improvements be filed with the
Clerk.
8. A bond for delayed staking shall be a part of
th.e agreement.
9. All utilities shall be undergrounded and ease-
ments for all public utilities be indicated on the map.
Future structures shall not be allowed to encroach upon pro-
ject utility lines to insure stability of these facilities
and provide for their adequate maintenance.
10. Any street lighting required shall be from a
design by th.e street light coordinator of the San Diego Gas
& Electric Company•
11. A detailed soils engineering and engineering
geology report, to be prepared by a.registered civil engineer
and registered geologist, containing recommended grading
procedures andspecifications shall be submitted with the
grading plan.
12. All soils work shall be done under the direction
of a soils engineer and geologist.
13. A copy of an agreement to serve from the
Sweetwater Authority shall be filed with the City Clerk prior
to th.e final map.
14. All new or reconstructed slopes within the pro-
ject area shall be a maximum of 2:1 as required by Section
18.102.120 of the National City Land Use Code. Any slopes
exceeding 25 feet in height and being less than the 2:1
required slope ratio shall have benches at a slope height
of 20 feet.
15. All easements of record are to be shown on the
final map along with. th.e proposed easements for dedication
(sewer, water, electric, telephone, T.V., drainage, pedestrian,
slope, ingress -egress, et al). Said easements shall be shown
with sufficient data to locate in the field.
16. That sewer fees be paid as determined by the
Director of Building and Housing at th.e time building permits
are issued.
17. A Planned Unit Development Permit is required
for site development. All conditions of approval of PUD-2-79,
shall also become conditions of approval for the tentative
subdivision map. (See Resolution no. 1980).
18. A copy of an agreement to serve from the City
of San Diego for sewer service, shall be filed with the City
Clerk prior to the final map.
19. Prior to the approval of the final map, a
landscape plan prepared by a qualified landscape architect
shall be approved by the City. Slope banks shall be stabilized
with an approved combination of soil -binding groundcover,
shrubs and trees. Groundcover plantings shall be installed at
a maximum spacing of.8", rather than 12" on center on any
slopes being less than the required maximum 2:1 slope ration.
20. Maintenance of slopes, common areas and areas
of useable open space within this subdivision shall be the
responsibility of th.e homeowner's association and shall be
provided for in the CC&R's. The CC&R's shall:
a) Clearly specify a "level of maintena ce"
to be expected of all landscaped areas and suitable measures
to guarantee compliance therewith by the homeowner's asso-
ciation.
b) Provide that the City may enter the
property and perform necessary maintenance work, and place
a tax lien on the property to cover the costs thereof.
c) Provide for the maintenance of and continued
unobstructed access to fire protection equipment and life
safety systems and appliances per City Ordinance 1591 and
Uniform Fire Code Sections 13.206, 13.207, 13.208 (a) through
(e) and 13.302 (a) and (b) as required by the City of
National City Fire Department.
21. Prior to approval of the final map, a copy of
the CC&R's shall befiled withand approved by the City
Attorney of National City.
22. Prior to the approval of the final map, the
following documents shall have been filed with and approved
by the National City Planning Department:
a) Diagrammatic floor plans
b) Consent to record
23. The residential density shall be consistent
withzoning regulations unless provisions for deviation are
made in conjunction with the Planned Unit Development Permit.
24. Water mains and fire hydrants shall be pro-
vided, capable of yielding a fire flow pressure of no less
than 2,000 GPM for a duration of three (3) hours with no less
than 20 PSI residual pressure. Hydrants shall be approved
as to number and location by the Fire Chief and installed
prior to building construction.
25. Park fees of $125.00 per unit shall be paid
at the time building permits are approved and issued.
26. Fees for interim school facilities per the
amounts required by the National City School District and
Sweetwater Union High School District for two and three
bedroom units shall be paid at the time building permits
are approved and issued, pursuant to National City Ordinance
No. 1622, unless the CC&R's approved by the City Attorney
of National City limits this condominium subdivision to adults
only.
27. The sale of this project and the CC&R's shall
be designed to discourage "speculative
investments and
ownerships. To this end, the following measures shall be
incorporated in the CC&R's:
a) The project developer shall not rent any
condominium unit.
b) Sales of new units shall be limited to
one per buyer/family.
28. Project private streets shall be constructed
in accordance with. National City standards for city streets.
29. Project private streets shall be surfaced with
Portland Cement Concrete and shall be, at a minium, 32 feet
wide.
30. Any private street exceeding 8 percent in grade
and intersecting another private street, shall be designed for
35 mile-per-hour.sight distance.
31. The project entrance off Rachael Street shall
be a regular street type entrance with curb returns and verti-
cal curves. The entrance shall be a prolongation of the curb
on Rachael Avenue.
32. The circle effect located at the project entrance
shall be deleted to avoid potential circulation related pro-
blems.
33. For purposes of complying with Article 2,
Section 66434, subsection (a), which indicates ..."the map
shall be legibly drawn, printed or reproduced by a process
guaranteeing a permanent record in black or tracing cloth or
polyester base film", please re -submit another map which will
make a permanent record.
34. That the Fire Department approve the design
on th.e hammerheads, with the added stipulation that if the
Fire Department cannot approve the design, th.e entire
Tentative Map shall be void.
