HomeMy WebLinkAboutCC RESO 13,500RESOLUTION NO. 13,500 RESOLUTION AUTHORIZING EXEECUTION OF AN AGREEMENT FOR VEHICLEUSE BETWEEN THE CITY OF NATIONAL CITY AND THE NATIONAL CITY MILE OF CARS BE IT RESOLVED by the City Council of the City of National that the Mayor are authorized and directed to agreement entitled, "Agreement and the City Manager execute that certain for Vehicle Use Between the City of National City and the National City Mile of Cars". PASSED AND ADOPTED this 13th day of January, 1981 ATTEST: CITY CLE AGREEMENT FOR VEHICLE USE BETWEEN THE CITY OF NATIONAL CITY AND THE NATIONAL CITY MILE OF CARS Section 1. Recitals.. The City of National City (City) and the National City Mile of Cars, an unincorporated association of merchants (Mile of Cars) desire to cooperate in engaging in activities for the suppression of crime within the City of National City. The City, through its Police Department, desires to have the use of various unidentified automobiles which can be used in the suppression of crime; and the Mile of Cars, through its members, desires to provide for the use of unidentified _ vehicles for crime suppressiond activities of the Police Depart- mentof the City of National City. The City of National City has insurance to insure against all losses arising out of the activities of its officers and agents; and the City of National City desires to hold harm- less the "Mile of Cars Association" and its members from any risk of loss arising from the activities of its police depart- ment. Section 2. Agreement. The City and the Mile of Cars' agree as follows: 1. Rental of cars: The MIle of Cars shall provide such motor vehicles as the City Police Department may describe for their use in its crime prevention program for the use of (N.C. Res. No. 13,500) the city police department upon the terms and conditions herein set forth. 2. The City shall insure the Mile of Cars and its members against claims and risk of loss arising from and out of, the activities of the officers of the City of National City. Section 3. Rental Fee. The City shall pay the Mile of Cars a rental fee for the use of its vehicles, provided through its various members of one dollar ($1.00) per month. Section 4. Indemnification. Anything to the contrary not withstanding, the City of National City shall indemnify and save the National City Mile of Cars free and harmless of all risk of loss and claim, including defense against actions, arising out of and from, the providing of vehicles to the City of National City and its police department for crime suppression activities, pursuant to this agreement. Section 5. Termination. This Agreement may be terminated, by either party, without'no€ice, by delivering a written declaration of intent to terminate as follows: City of National City: City Manager Mile of Cars: The then president of the Mile of Cars, or the owners, or any member dealer thereof. -2- IN WITNESS WHEREOF the City shall execute this Agreement. on this day of by and through its Mayor and City Manager and the Mile of Cars has executed its agreeMent'by and through its president, on this' day of January, 1981.
