HomeMy WebLinkAboutCC RESO 13,512RESOLUTION NO. 13,512 RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT BETWEEN CITY OF NATIONAL CITY AND SAN DIEGO COUNTY DEPARTMENT OF PUBLIC WELFARE. Be it resolved by the City Council of the City of National City that the Mayor is hereby authorized and directed to execute, and the City Clerk is authorized to attest, that certain agreement between the City of National City and the San Diego Department of Public Welfare for their Food Stamp Workfare Demonstration Project. Ca.,enter into this Agreement the 14 day of April , 1981 • This Agreement is entered into under authority of the Food Stamp Workfare Demonstration Project (7 U.S.C. G 2026) and the Food Stamp Act (42 U.S.C. G 602). The terms and conditions of this Agreement shall be carried out by the Department of Social Services and,the Work Site in accor- dance with requirements of the Workfare Demonstration Project and the Food Stamp.Act, including ,,a1.1 rules and regulations promulgated pursuant thereto, and any subsequent amendments (a copy the pertinent regulations is attached and made a part of this Agreement). If and when the :rms and conditions of this Agreement conflict with the Workfare Demonstration Project, the Sod Stamp Act, or their regulations, the Workfare Demonstration Project and the Food Stamp Act fall prevail. The County of San Diego and Work Site to be contracted agree: 1. The term of the Agreement is from 4/14/81 through 9/30/81 2. The Work Site shall provide 1000 hour(s) per month of supervised work activity for Workfare participants referred to the Work Site by the County of San Diego in the occupation(s) and in accordance with the job order attached hereto and incorporated herein. 3. Compensation for Workfare employment shall be paid in the form of the Food Stamp coupon al- lotment to which the household is normally entitled. 4. Worker's Compensation coverage shall be provided by the County of San Diego. 5. During the work activity, the Work Site shall provide each participant with: a. The same benefits as other employees similarly employed. b. Safety instructions and equipment necessary for reasonable protection against injury and damage. c. Reasonable and proper supervision and instruction by Work Site, regarding duties and work activity. 5a. In addition, the Work Site agrees: a. To report on participant's attendance and other such information on performance as may be requested by the County of San Diego. b. To consider the Workfare participant for any job openings occurring at the Work Site. 6. The County of San Diego has the right to observe and monitor all conditions and activities involved in the performance of the Agreement. 7. The Work Site shall abide by the assurances incorporated herein. 8. The Work Site, and any agents and employees of the Work Site, in the performance of the Agreement, shall act in an independent capacity and not as officers, employees, or agents of the County of San Diego. The Work Site shall not subcontract in the name of the County of San Diego. 9 The Work Site, its agents, officers and employees, shall not be held liable for liabilities, penalties, fines or damage, legally caused or incurred by the acts of the County of San Diego, its agents, officers and employees. The County of San Diego, its agents, officers and employees, shall not be held claims, liabilities, penalties, fines or damage, legally caused or incurred by omissions of the Work Site, its agents, officers and employees. 10. No alteration or variation of the terms of this Agreement shall be valid and/or binding un- less made in writing and signed by the parties hereto; there are no oral understandings or agreements not incorporated herein. 11. Either party may terminate this Agreement upon ten (10) days prior written notice. The Count of San Diego may immediately terminate this Agreement at such time as directed by the County of San Diego Board of Supervisors.
