RESOLUTION NO. 13,520
RESOLUTION AUTHORIZING EXECUTION OF SUPPLEMENTAL
AGREEMENT NO. 5 TO CALTRANS-NATIONAL CITY AGREE-
MENT FOR THE FEDERAL AID URBAN PROGRAM.
BE IT RESOLVED by the City Council of the City of
National City, California, as follows:
That the Mayor is hereby authorized and directed
to execute and that the City Clerk is authorized to attest
that certain Supplemental Agreement No. 5 between CALTRANS
and National City, for th.e Federal Aid Urban Program.

Local Agency
Pursuant to the Federal Aid for Urban Systems Acts, the attached "Program" of Federal Aid
Urban System Projects marked "Exhibit B" is hereby incorporated in that Master Agreement for
the Federal -Aid Program which was entered into between the above named LOCAL AGENCY and
the STATE on November 17, 1978 and is subject to all of the terms and conditions
thereof.
The subject program is adopted in accordance with Paragraph 2 of Article II of the aforemen-
tioned agreement under authority of City&Gauittet Resolution No. /3, s vo

SpecidCovenants or Remarks: 1. All maintenance, involving the physical condition and the operation
of the improvements, referred to in Article VI MAINTENANCE of the
aforementioned Master Agreement will be performed by the City of
National City and Caltrans for their respective portions at regular intervals or as required
for efficient operation of the completed improvements.

2. The City and State will prepare PS&E, for their respective portions. The City will
advertise and award the contract and pay the contractor on this project.
3. The actual funds for the project will be set up on the basis of contract prices
after the bids for the work have been opened. In awarding, or agreeing to award
the contract, the Local Agency agrees that the payment of Federal funds will be
limited to the detail estimate amount approved by the Federal Highway Administra-
tion in the Federal -Aid Project Agreement (PR-2), or its modification PR-2A, and
accepts any increases in Local Agency funds.
4. The availability of Federal funds will be subject to meeting deadlines and/or
other conditions as may be imposed by the Director upon the recommendation of
the Federal -aid Urban Advisory Committee.
5. The use of Federal funds for this project is subject to the project being selected
as part of the interim and the multi -year FAU Program for San Diego County.
6. In executing this Program Supplemental Agreement, local agency hereby reaffirms the
"nondiscrimination assurances" contained in the aforementioned Master Agreement for
Federal -Aid Program.
