BE IT RESOLVED by the City Council of the City of National City that the Mayor is authorized and directed to execute that certain Engineering Consultant Agreement with Pountney and Young, Incorporated,for reconstruction of 22nd Street, including construction of Quadruple 4' X 10' box culvert on Paradise Creek, and improve Paradise Creek between 22nd and 24th Streets. PASSED AND ADOPTED this 22nd day of January, 1980. Civil Engineers hereinafter called "consultant," is as follows: The client intends to reconstruct 22nd St. including construction of 0uadruple 4'x 10' box culvert on Paradise Creek, and improve Paradise Creek between 22nd and 24th Streets. hereinafter called the "project." The present record owner is: - Name: Natinnal City Business Address: 1243 National City Residence: - The client and consultant for mutual consideration hereinafter set forth, agree as follows:- A- Consultant agrees to perform the following services: Design reconstruction of 22nd Street between Hoover and Wilson including. drainage culvert for Paradise Creek and design improvement of Paradise Creek between 22nd and 24th Streets per proposal dated November 30, 1979 attached hereto. B. Client agrees to compensate consultant for such services as follows: Lump Sum fee $22,920 CNote7— tinder u of this agreement, a late payment PENANCE. CHARGE will be computed at the _periodic rate of 0.833% per month which n as ANNUAL PE CENTAGE EATS of 10%b, and will be applied- to any napaid balance commencingday, after the date of the original invoice. CNote3—Under provisions of• this agreement, client agrees to limit the liability of consultant in accordance with i28 of the Standard Provisions set forth upon the reverse side. C. The standard provisionsset forth upon the reverse side are incorporated hereinto and made a part of this agreement.
