RESOLUTION OF THE CITY COUNCIL OF NATIONAL
CITY, CALIFORNIA APPROVING TENTATIVE SUB-
DIVISION MAP - SHELL MANOR II (sixth
revised edition) (S-48)
BE IT RESOLVED by the City Council of the
City of National City, that the tentative map for
Shell Manor II (sixth revised edition) (S-48) be
approved subject to the following conditions:
1. Compliance with revised map dated December
27, 1979 (sixth revised map).
2. Final map shall indicate all survey and
mathematical information, monuments set and found,
bearings and distances and ties to existing monuments.
3. A grading plan, including drainage,
drainage facilities and appurtenances, showing off-
street improvements, shall be approved by the City
Engineer prior to the approval of the final map.
4. Street improvement drawings shall be
approved prior to approval of the final map. These
drawings shall include local drainage, water, sewers,
street lights, fire hydrants, curbs and all appurten-
ances thereto.
5. Installation of a minimum 4'0' high
decorative wrought iron protective fence on top of
the retaining wall along the north side of "A" Street
where it abuts neighboring property and on top of
the project.
6. That one foot barrier lots be deeded to
the City of National City, in fee simple, along the
north side of "A" Street, where it abuts neighboring
property (Lot "A") and where the subdivision boundary
abuts Peachblossom Street.
7. The final map for this subdivision
shall not be approved until:
a) Lot No. 1 is made to comply with Land
Use Code requirements for minimum width, or until an
appropriate zone variance is allowed .by the City.
b) Compliance with. FHA design suggestions
is made.
c) A minimum 20' width improved roadway from
Mariposa Place has been provided along Capella Street
to serve Lots 1 through. 5.
d) The City Council has authorized red
curbs within the cul-de-sac.
8. That private easements for slope and
landscape maintenance be granted on Lots 1 through 5
to the benefit of abutting "down -slope." lots.
9. That all slopes more than 3' high shall
be landscaped, according to City standards, by the
subdivider. This to include permanent underground
irrigation systems metered and controlled from the pad
elevation of each. lot. Covenants, Conditions, and
Restrictions shall provide for maintenanceof all
such landscaping, with provisions allowing City to
enter, maintain and impose tax liens for that work
whenever a finding is made that this landscaping is
being neglected.
10. All lots shall drain in concrete swales,
conduits, or to the street but not over any slopes
unless contained.
11. Letters of permission, in detail as to
the work to be done, shall be secured from adjoining
owners for any work to be done off -site and copies of
said letters are to be filed with the City Engineer
prior to approval of the final map.
12. Utilities are to be underground.
13. Street lights are to be provided by the
owner from a design by the street light coordinator
of the San Diego Gas and Electric Company and approved
by the City Engineer.
14. Copies of letters from the Sweetwater
Authority and the City of San Diego agreeing to serve
water and/or sewer shall be filed with the City
Engineer prior to approval of the final map.
15. All soils work to be done under the
direction of soils engineer. A soils report and a geo-
logical report are to be filed with the City and noted
on the final map prior to its approval.
16. All easements of record and proposed
easements for any purpose are to be shown on the final
map and their purpose clearly stated thereon.
17. All owners of record and of easements
that can ripen into a fee shall be indicated on the
title sheet and the easements shown on the final map
prior to its approval.
18. Sewer fees are to be determined by the
Director of Building and Housing and paid prior to the
approval of the final map.
19. A subdivision agreement between the dev-
eloper and the City for the timely completion of the
public improvements required and the delayed staking,
with acceptable security attached, shall be accepted
by the City Council prior to approval of the final map.
20. Park fees in the amount of $125.00 per
dwelling unit shall be paid by the developers at the
time any building permits are issued.
21. All slopes within the project boundary
shall be a maximum of 2:1. *
22. Prior to the approval of the final map,
a street tree plan shall be approved by the City.
23. Street trees shall be installed by the
developers in accordance with the approved street tree
plan before any dwelling units are occupied.
24. Prior to the approval of the final map,
a copy of the covenants, conditions and restrictions
shall be filed with and approved by the City Attorney

of National City.
The covenants, conditions shall:
1) Clearly specify a level of maintenance
to be expected of all required landscaped areas and
drainage facilities and identify suitable measures to
guarantee compliance therewith by the individual home-
owners.
2) Provide that the 1'0" barrier lot abutting
neighboring property along the north side of "A" Street
be maintained by the Homeowner's Association in
accordance with adopted city standards. They shall
further provide that in the event other required land-
scaped areas and drainage facilities are not maintained
by individual homeowners, the Homeowner's Association
shall be responsible for their maintenance, in accord-
ance with adopted city standards.
3) Provide that the City may enter the pro-
perty and perform any necessary maintenance work and
place a tax lien on the property to cover the costs
thereof.
25. Cul-de-sac shall be red curbed and posted
"No Parking".
26. Hydrant locations and water main exten-
sions to serve said hydrants shall be provided accord-
ing to the information shown on the tentative map.
27. All proposed structures shall comply with
the seismic safety considerations in Chapter 2312 of
the Uniform Building Code and all requirements per-
taining thereto shall be calculated and certified by
an architect or structural engineer registered by the
State of California.
28. Lots 6 through 11 shall be provided with
permanent stairways, ramps or ladders, approved by the
Department of Building and Housing, to allow convenient
access to both of the upper terraces from each. pad.
29. Ground cover planting (white trailing
ice plant), indicated on slope landscaping plans sub-
mitted for the subdivision, shall be planted at a
maximum of 8" rather than 12" on center.
30. Erosion control fabric be installed on
specified slopes within the subdivision and on slopes
3' in vertical height and higher.
Pre -emergence weed
controls shall be used prior to installation of erosion
control fabric.
31. The visual impacts of the subdivision's
proposed retaining walls be mitigated by landscaping
(vines). Plant materials, which will cascade down
retaining wall surfaces, shall be installed along the
tops of retaining wall surfaces and shown on the required
landscape plan.
32. Adherence to the grading and develop-
ment practices outlined in th.e soils and geologic
investigation and observance of required building set-
backs.
33. A registered geologist be present on the
property to observe the westerly portions of the pro-
ject site during grading operations.
34. Construction of the project's proposed
drainage appurtenances and adherence to the drainage
control recommendations, contained in the soils and
geologic investigation.
35. Strict observance of lot line setbacks
within the proposed subdivision and the inclusion of
intersection separation (100') along Shell Avenue
between "A" Street proposed in Shell Manor II and 5th
Street of approved Shell Manor I.
36. Adherence to recommended grading
practices identified in the project's soils and geo-
logic study to assure stability of the proposed
1-1/2:1 slopes to a maximum height of 50'.
37. Adherence to the development specifica-
tions outlined in the project's soils and geologic
study for the development of the project site's
steep slopes.
38. The surface drain and down drains on
Lots 6 through 11 are not to be indicated on the final
map and shall not become a public responsibility
through easement dedication.
39. The surface slope drains indicated on
Lots 5,12, through 17 shall not be indicated on the
final map and shall not become a public responsibility
through easement dedication.
40. The drainage easement indicated on Lots
12 and 13 from the cul-de-sac to the subdivision boundary
is to be indicated on the final map and offered for
dedication.
41. The sewer easement indicated on Lot 14
is to be indicated on the final map and offered for
dedication.
42. Streets are to be improved and dedicated
as shown on the revised map dated December 27, 1979
("Sixth Revised Map"). This is to include the curb
and gutter on Peachblossom Street, (off -site) as
shown on the map.
43. The final map will not be approved until
the Sweetwater Authority and the San Diego Water
Utilities Department have advised the City Engineer
and Fire Chief that the project will forthwith be
served by a water system meeting fire department speci-
fications of 1,000 gallons per minute. (See attached
fire department memo dated November 26, 1979).
44. That a performance bond guaranteeing
successful growth and maintenance of all slope land-
scaping repair of slope erosion for a period of two
years be posted by the developer. (See attached City
Engineer's memo dated November 27, 1979.)
45. That the required on -site soils engineers
and geologists shall perform supplemental investiga-
tions, analysis, design specifications, testing and
inspections ordered by the City Engineer. Upon com-
pletion of the site improvement work, the City Engineer
will withhold approval and release of bonds until
adequate "as built" soils and geologic analysis have
been prepared to his satisfaction and filed with the
City. All costs to be paid by the subdivider.
