RESOLUTION ACCEPTING COVENANT RUNNING WITH
THE LAND AND DIRECTING THE RECORDING
THEREOF

BE IT RESOLVED by the City Council of the City
of National City that a Covenant granted to the City of
National City by Monica E. Teyssier, affecting the
property at 3200 Highland Avenue, National City, is
hereby accepted and the City Clerk is directed to record
the same.
PASSED AND ADOPTED this 12th day of February, 1980.

COVENANT RUNNING WITH THE LAND
This COVENANT is made by Monica E. Teyssier, hereinafter referred to as "OWNER".
WHEREAS OWNER is the owner of that certain real property located. in the City of National
City, County of San Diego, State of California, described as follows:
Parcel I: The south 205.00 feet of the East Half of the East Half of 10 acre Lot 9
in Quarter Section 152, all in Rancho de la Nacion, in the City of National City,
in the County of San Diego, State of California, according to Map thereof No. 166
filed in the office of County Recorder of San Diego County.
Excepting from said East Quarter of 10 Acre Lot 9, the Westerly 10 feet of the
Easterly 50 feet of the Westerly 130 feet thereof, as granted to the County of
San Diego, by deed recorded August 25, 1958, in Book 7227, Page 170 of
Official Records.
Parcel II: The East Half of the East Half of 10 Acre Lot 16 in Quarter Section 151,
all in Rancho de la Nacion, in the City of National City, in the County of San Diego,
State of California, according to Map thereof No. 166 filed in the office of County
Recorder of San Diego County, excepting therefrom that portion "taken" for State
Highway purposes described as Parcel 3-A in that certain final order of condemnation
No. 336275 recorded June 18, 1974, as File No. 74-162317.
WHEREAS, said owner desired to be excused from the legal requirements to install the
following improvements:
Portland cement curbs, gutters, sidewalks and driveways on the west side of Highland
Avenue, fronting the subject property. (Highland Avenue surface frontage improvements).
NOW, THEREFORE, in consideration for the granting of a deferral to install said improve-
ments by the City Council of the City of National City, said owner covenants for herself and
her heirs, successors, assigns, executors and administrators as follows:
In the event California State Highway 54 and its related appurtenances adjacent to
the subject property is abandoned, said owner agrees relative to said Highland Avenue
surface frontage improvements:
1. The owner will not protest the installation of any of the required improvements
under 1911 Improvement Act program whether initiated by the property owners
or the City.

2. The owner will install said improvements in conjunction with an overall
improvement program of the area whether initiated by the property owners
or the City.
3. The owner will install the required improvements within 30 (Thirty) days of
a written demand to do so by the City Engineer.
