HomeMy WebLinkAboutCC RESO 16,172RESOLUTION NO. 16 172 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA, APPROVING A PLANNED DEVELOPMENT PERMIT FOR A 2-&iV Y, 3000 SQ.FT. OFFICE BUILDING IN THE CG ZONE AT THE NORTHEAST CORNER OF EUCLID AVENUE AND SWEETWATER ROAD APPLICANT: WITKIN DESIGN FOR DAVID & ANNIE MALCOLM AND WILMA SOUTHWORTH CASE FTT,F NO.: PD-3-89 WHEREAS, the appeal to the City Council of the Planning Commission's approval of application for Planned Development Permit Application (PD-3-89) was considered by the City Council of the City of National City at a public hearing held on January 23, 1990, at which time oral and documentary evidence was presented; and, WHEREAS, at said public hearing the City Council considered the entire contents of Case File Nos. PD-3-89 and IS-89-6 which are maintained by the City, and incorporated herein by reference; and, WHEREAS, this action is taken pursuant to all applicable procedures required by State and City law; and, WHEREAS, the action recited herein is found to be essential for the preservation of public health, safety and general welfare. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City, California, that the testimony and evidence presented to the City Council at the public held on January 23, 1990 support the following findings: A. That the site for the proposed use is adequate in size and shape, because the 8872 sq.ft. site is sufficient in area for a 3000 sq.ft. office building with required parking and landscaping. B. That the site has sufficient access to streets and highways that are adequate in width and pavement type to carry the quantity and quality of traffic generated by the proposed use, because the site is located at the northeast corner of Sweetwater Rd. and Euclid Avenue, both arterial roads with adequate capacity to serve the proposed use. The office use will not generate a substantial amount of traffic. There would be no vehicular access from Sweetwater Road. C. That the proposed list. will not have an adverse effect upon adjacent or abutting properties, because the site is bounded by I-805 to the east, Euclid to the north and west, and Sweetwater Rd. to the south. Residences to the west are located approximately 150 ft. from and approximately 30-40 higher in elevation than the project site, a sufficient distance to avoid potential disturbance from activity on the site. D. That the proposed use is deemed essential and desirable to the public convenience or welfare, because the previous zoning was changed to specifically provide for construction of an office building. BE IT FURTHER RESOLVED that the City Council has considered the proposed Negative Declaration No. IS-89-6 together with any comments received during the public review process, and find on the basis of the Initial Study and any its received that there is no substantial evidence that the project will have a significant effect on the environment, approves the Negative Declaration, and authorizes the filing of a Notice of Determination. BE IT FURTHER RESOLVED that the application for Planned Development Permit is approved subject to the following conditions: 1. All public improvements shall be per San Diego Regional Drawing, 1986 edition and Standard Specification for Public Works, 1985 edition. 2. The attached plans shall be approved by Caltrans, and a letter of approval shall also be obtained from Caltrans. 3. The engineering cost estimate shall be submitted and 3% of the improvement cost shall be submitted with the City Treasurer prior to Engineering Department approval for plan processing and field inspection. 4. The improvements shall be in accordance with the approved grading plan. 5. The Required Fire Flow for this project will be 1500 GPM for 2 hours at a minimum 20 PSI residual. Sweetwater Authority must verify in writing to the Fire Department that this flow can be met. 6. A fire hydrant will be required on Euclid Avenue. 7. The driveway entrance and exit shall be a minimum 20 ft. in width per the Uniform Fire Code. Fire lanes shall be provided where necessary as designated by the Fire Department. 8. Type 2A:10BC fire extinguishers shall be provided. 9. The exits shall' t the requirements of the Uniform Building Code. 10. The building address shall be visible from Euclid Ave. and Sweetwater Rd. and shall be on a contrasting background. 11. Landscaping shall be separated from adjacent parking and vehicular circulation by a minimum 6 in. by 6 in. concrete curb with footing. 12. All parking spaces shall be marked with hairpin lines, 4 to 6 inches in width forming a band between 12 and 24 inches wide around each side of the stall. 13. All compact parking spaces shall be marked for compact use only. 14. Sef+ cks shall remain free and clear from the ground upward except for landscaping. 15. Parking spaces shall be 9 X 19 ft., with a maximum overhang of 30 inches into non -setback areas. 25% of the total number of parking spaces may be allocated for compact cars with minimum dimensions of 8 X 16 ft. 16. A comprehensive sign package, including a "Welcome to National City' monument sign in substantial conformance with the City's design standard, shall be submitted with the final plans and approved by the Planning Department. 17. Trash enclosure shall be built in accordance with City Standards. 18. Driveways shall be right -turn only for ingress and egress from Euclid Avenue only, and shall be marked and identified as such. 19. Median improvements shall be constructed in Euclid Avenue to restrict left turn movements to and from the project site, if determined necessary after review of the traffic situation by the City Engineer 6 months after project completion. The applicant shall provide a bond, letter of credit, or other performance security for the median improvements (approximately $20,000) to the satisfaction of the City Engineer. 20. Except as otherwise indicated by conditions of approval, develwment plans shall be submitted and approved by the Planning Director in conformance with Exhibit "A revised", Case File No. PD-3-89. 21. Before this Planned Development Permit shall become effective, the applicant shall sign and have notarized an Acceptance Form, provided by the Planning Department, acknowledging and accepting all conditions imposed upon the approval of this permit. The applicant shall also submit evidence to the satisfaction of the Planning Director that a Notice of Restriction on Real Property is recorded with the County Recorder. The applicant shall pay necessary recording fees to the County. The Notice of Restriction shall provide information that conditions imposed by approval of Planned Development Permit No. PD-3-89 are binding on all present or future interest holders or estate holders of the property. The Notice of Restriction shall be approved as to form by the City Attorney and signed by the Planning Director prior to recordation. 22. Use of the property shall be limited to offices as allowed in the General Commercial zone. 23. This permit shall became null and void if not exercised within one year after adoption of the resolution of approval unless extended according to procedures specified in Section 18.116.190 of the Municipal Code. BE IT FURTHER RESOLVED that copies of this Resolution shall be transmitted forthwith to the applicant and, BE IT FURTHER RESOLVED that this Resolution shall become effective and final on the day following the City Council n sting where the resolution is adopted. The time within which judicial review of this decision may be sought is governed by the provisions of Code of Civil Procedures Section 1094.6.
