RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY DECLARING NECESSITY TO ACQUIRE REAL
PROPERTY BY EMINENT DOMAIN FOR MUNICIPAL PURPOSES
(2021 EUCLID AVENUE OWNED BY DONALD H. HAGER)
BE IT RESOLVED by the City Council of the City of
National City as follows:
SECTION 1: The public interest, convenience and
necessity of the City of National City and the inhabitants thereof
require the construction, maintenance and operation of Euclid
Avenue from Plaza Boulevard to 22nd street located in the City of
National City, County of San Diego, State of California.
SECTION 2: At their meeting of February 27, 1990, the
City Council of the City of National City considered the necessity
of the acquisition of fee title to a portion of the real property
and improvements located at 2021 Euclid Avenue by eminent domain
proceedings, for purposes of the construction of Euclid Avenue from
Plaza Boulevard to 22nd Street.
SECTION 3: The public interest and necessity require
said project and require the acquisition of said real property in
fee, and the project and acquisition are for a public use.
SECTION 4: The taking of said real property for
municipal purposes by eminent domain proceedings is authorized by
Government Code Sections 37350, 37350.5, 37351, 37353 and 40404.
SECTION 5: The proposed project is planned and located
in a manner which will be compatible with the greatest public good
and the least private injury.
SECTION 6: The offer required by Section 7267.2 of the
Government Code has been made to the owner or owners of record.
SECTION 7: The City Attorney is hereby authorized and
directed to commence and maintain in the name of the City of
National City such actions and proceedings of eminent domain in the
Superior Court of California, County of San Diego, as are necessary
to acquire in fee, for the purpose and uses aforesaid, that certain
real property commonly known as 2021 Euclid Avenue, which is
situated in the County of San Diego, and within the City of
National City, State of California, more particularly described as:
THE SOUTHERLY 50.0 FEET OF THE NORTHERLY 118.00 FEET OF THAT
PORTION OF THE NORTHWESTERLY QUARTER OF THE SOUTHWESTERLY QUARTER
OF QUARTER SECTION 107 OF RANCHO DE LA NACION, IN THE CITY OF
NATIONAL CITY, COUNTY OF SAN DIEGO, STATE OF CALIFORNIA, ACCORDING
TO THE MAP THEREOF NO. 166 BY MORRILL, FILED MAY 11, 1869 IN THE
OFFICE OF THE COUNTY RECORDER OF SAID SAN DIEGO COUNTY, DESCRIBED
AS FOLLOWS:
BEGINNING AT THE NORTHWESTERLY CORNER OF LOT 1, BLOCK "A" OF F.A.
RICHARD'S SUBDIVISION, ACCORDING TO MAP THEREOF NO. 2459, FILED IN
THE OFFICE OF THE COUNTY RECORDER; THENCE SOUTH 70°51' WEST ALONG
THE WESTERLY PROLONGATION OF THE NORTHERLY LINE OF SAID LOT 1, A
DISTANCE OF 136.28 FEET; THENCE SOUTH 18°56'15" EAST 238 FEET;
THENCE SOUTH 79°13' EAST (RECORD SOUTH 79° EAST) 160.43 FEET;
THENCE NORTH 18°58'30" WEST 315.89 FEET TO THE POINT OF BEGINNING.
PASSED and ADOPTED this 27th day of February, 1990.
