A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NATIONAL CITY, CALIFORNIA, APPROVING
A CONDITIONAL USE PERMIT FOR
A CHURCH
AT 2410 EAST 8TH ST.
APPLICANT: FERNANDO S. MATA
CASE FTT.F NO. CUP-1989-16
WHEREAS, the appeal of the City Council from the Planning Commission's
approval of Conditional Use Permit Application (CUP-1989-16) was considered by
the City Council of the City of National City at a public hearing held on
April 24, 1990, at which time oral and documentary evidence was presented; and,
WHEREAS, at said public hearing the City Council considered the entire
contents of Case File Nos. CUP-1989-16 and IS-89-46 which are maintained by the
City, and incozporrated herein by reference; and,
WHEREAS, this action is taken pursuant to all applicable procedures
required by State and City law; and,
WHEREAS, the action recited herein is found to be essential for the
preservation of public health, safety and general welfare.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
National City, California, that the testimony and evidence presented to the City
Council at the public hearing held on April 24, 1990, support the following
findings:
A. That the site for the proposed use is adequate in size and shape,
because the .65 acre parcel is developed with an 8,000 sq.ft. building
that is adequate in size for a church and church -related activities.
B. That the site has sufficient access to streets and highways that are
adequate in width and pavement type to carry the quantity and quality
of traffic generated by the proposed use, because the site has 190 ft.
of frontage on 8th Street, an arterial roadway, from which it will
take access. 8th Street has adequate capacity to handle the traffic
expected to be generated from the church.
C. That the proposed use will not have an adverse effect upon adjacent or
abutting properties, because the site is surrounded by a commercial

BE IT FURTHER RESOLVED, that the City Council has considered Negative
Declaration No. IS-89-46, approved by the Planning Commission March 5, 1990, and
certifies that the Negative Declaration has been approved pursuant to the
requirements of the California Environmental Quality Act, and that the Initial
Study and Negative Declaration adequately address the effects of the project as
conditionally approved.
BE IT FURTHER RESOLVED that the application for Conditional Use Permit
is approved subject to the following conditions:
1. Change in occupancy classification requires that the building be
upgraded to current code requirements for structural strength, fire -
resistive construction, exiting, allowable floor area, and other life
safety requirements based upon the new occupancy classification.
Plans shall comply with UBC, UPC, UMC 1988, NEC 87 and Title 24
requirements for the new proposed occupancies.
2. A grading plan including the location and specifications for the new
retaining wall shall be submitted for review and approval by the
Engineering Department. The grading plan shall be in accordance with
the approved site plan.
3. The deteriorated portions of the gutter on 8th Street and the most
westerly driveway shall be repaired.
4. A performance bond equal to the approved cost estimate for all
proposed work shall be posted.
5. A permit shall be obtained from the Engineering Department for all
improvement work within the public right-of-way and all grading
operations on private property.
6. The applicant shall obtain the check print of the site plan with the
noted corrections and comments from the City Engineering Department.

corrections. The check print and the revised prints shall be re-

contractor for review and approval prior to any work being done. The
building shall not be occupied or used for church business until the
sprinkler system is installed and approved by the Fire Department.
11. The Required Fire Flow will be 1500 GPM for 2 hours at a minimum 20
PSI residual. Sweetwater Authority shall verify in writing to the
National City Fire Department that this flow is available.
12. In lieu of a turn -around for fire apparatus on the westernmost side of
the property, the existing gate at the south end shall be used which
is currently secured with a lock and chain.
13. Red curbs and "No Parking" signs shall be provided as designated by
the Fire Department upon completion of the project.
14. The street address shall be visible and on a contrasting background.
Numbers shall be a minimum of four (4) inches high.
15. One (1) hour construction shall be provided between the garage and the
hallway, and the garage and Classroom #4.
16. Exiting shall be po.r the Uniform Building Code. Exit light shall also
be per the Uniform Building Code.
17. Smoke detectors approved by the California State Fire Marshal's Office
shall be provided in the nurseries.

21. The guardrail on top of the retaining wall shall be a minimum of
42 inches in height.
22. A sign permit shall be obtained for all signs.
23. Church services and classxcon hours, except for special events
occurring no more than 6 times a year, shall be as follows:
Wednesdays - 7:00 p.m. - 8:30 p.m.
Fridays - 7:00 p.m. - 9:00 p.m.
Sundays - 10:00 a.m. - 12:00 noon
6:00 p.m. - 8:00 p.m.
24. Development plans shall be submitted and approved by the Planning
Director in conformance with Exhibit "A -revised, dated 1/5/90", Case
File No. CUP-1989-16.
25. Before this Conditional Use Permit shall become effective, the
applicant shall sign and have notarized an Acceptance Form, provided
by the Planning Department, acknowledging and accepting all conditions
imposed upon the approval of this permit. The applicant shall also
submit evidence to the satisfaction of the Planning Director that a
Notice of Restriction on Real Property is recorded with the County
Recorder. The applicant shall pay necessary recording fees to the
County. The Notice of Restriction shall provide information that
conditions imposed by approval of Conditional Use Permit No. CUP-1989-
16 are binding on all present or future interest holders or estate
holders of the property. The Notice of Restriction shall be approved
as to form by the City Attorney and signed by the Planning Director
prior to recordation.
26. Use of the property shall be limited to a church and church -related
activities in accordance with CUP-1989-16.
27. This permit shall become null and void if not exercised within one
year after adoption of the resolution of approval unless extended
according to procedures specified in Section 18.116.190 of the
Municipal Code.
BE IT FURTHER RESOLVED that this Resolution shall became effective and final
on the day following the City Council meeting where the resolution is adopted.
The time within which judicial review of this decision may be sought is governed
by the provisions of Code of Civil Procedures Section 1094.6.
