NATIONAL CITY AUTHORIZING THE CITY ENGINEER TO
SOLICIT BIDS FOR THE SALE OF THE
CITY -OWNED SURPLUS PROPERTY
AT 1431 FIG COURT

BE IT RESOLVED by the City Council of the City of
National City that the City Engineer is hereby authorized to
solicit bids for the sale of the City -owned surplus property
at 1431 Fig Court (A.P.N. 551-613-15).
PASSED and ADOPTED this 5th day of June, 1990.

INSTRUCTIONS FOR SUBMITTING SEALED WRITTEN BID

THIS PACKAGE CONTAINS:
1. A cosy of the Intention to Sell Real Property and Notice Inviting
Bids setting forth the terms of sale, and the time and date for
the opening of sealed written bids.
2. A bid for Purchase of Real Property form upon which all sealed
written bids must be submitted.
BIDDING PROCEDURE INSTRUCTIONS AND INFORMATION:
1. Fill out the enclosed Bid for Purchase of real Prot rty form.
ALL WRITTEN BIDS MUST BE SUBmIlaED ON THIS FORM.
2. Insert your completed bid form in an envelope together with a
CASHIER'S CHECK, made Payable to CITY OF NATIONAL CITY in an
amount of not less than $10,000 as security deposit. The bid
envelope must be signed by the bidder in the upper left-hand
corner and marked "Sale of Surplus Property Bid A.P.N. 551-613-
15. WRITTEN BIDS received without this required security deposit
or IN AN ENVELOPE NOT SIGNED BY THE BIDDER MAY BE REJECTED.
3. Seal and sign the bid envelope containing your written bid and
the other required items, and deliver or mail it to the office of
the City Clerk of National City, 1243 National City Boulevard,
National City, CA. 92050. Mailed bid packages should be sent by
CERTIFIED MAIL.

4. SEALED WRITTEN BIDS SHALL RF RECEIVED BY THE OekICE OF THE CITY
CLERK NO LATER THAN 3:00 P.M., Monday, July 30, 1990 at which
time they will be opened and declared in the Targe Conference
Room, 2nd floor of City Administrative Building.
5. A bid package may be withdrawn any time prior to the time
scheduled for the formal bid opening by proper application and
identification to the City Engineer, who has custody to the
submitted bids. Anytime after the time scheduled for formal bid
opening, no bid package may be withdrawn without City Council's
approval and a bidder so withdrawing after the prescribed time
may be held liable for cages and costs to the City of National
City incurred as a result of said withdrawal.
6. After the opening and declaration of written bid packages, the
City Engineer will invite responsible 0Arties to make bids
orally. The first oral bid must exceed the highest qualifying
written bid by at least five percent (5%). A party needs to
submit a written bid in order to make an oral bid.
7. Upon recognition by the City Engineer of the first oral bid, the
procedure is considered to be an auction. Each oral bidder must
immediately pay by CASHIER'S CHECK, the required $10,000 security
deposit. An oral bidder who has previously submitted the
required security deposit with a written bid will not be required
to make an additional deposit at this time.
8. Upon completion of the bidding procedure, all bid packages will
be reviewed by the City Engineer. The final decision to sell the
property will be made by the City Council.
9. The plans for the property are available for inspection at the
Engineering Department, City of National City, 1243 National City
Boulevard, National City, CA. 92050.

INTENTION TO SELL REAL PROPERTY
AND NOTICE INVITING BIDS
CITY OF NATIONAL CITY
1243 NATIONAL CITY BOULEVARD
NATIONAL CITY, CA 92050
1. The City Council of National City, declares its intention to sell, as
is, where is, under the terms and conditions :,et forth herein, a real
estate property that is no longer required for the City use, situated
in the City of National City, County of San Diego, State of
California, and briefly described as follows:
The property is located at 1431 Fig Court, National City, California.
The property, according to the City of National City Planning
Department, are currently zoned as RT, (Two Family Residential), the
total area of the lot is 3,673 sq. ft. approximately; the total living
area is 1,242 sq. ft. The improvements consist of 3 bedrooms, two
baths, and one -car garage.
2. Minimum Bid: $95,000
3. Bids: A bid form will be Provided by the Engineering Department, City
of National City, upon request. Sealed written bids must be submitted
on said foLth, signed by bidder, and inserted and sealed in the bid
envelope. Said sealed bids shall be received by the Office of the
City Clerk of the City of National City, 1243 National City Boulevard,
National City, California 92050, until 3:00 P.M. on Monday, July 30,
1990. At or about which time set for the bid opening, said bids will
be publicly opened, declared and considered in the Targe Conference
Room, 2nd Floor of the City Administration Building.
Anytime before the time scheduled for formal bid opening, a bidder
upon proper application and identification to the City EnginePr, shall
have the right to withdraw his bid, and the bid package security shall
be returned to said bidder.
No written bid may be withdrawn after the time set for the bid opening
without the City Council's approval, and a bidder so withdrawing the
bid may be held liable for damages and costs to the City incurred as a
result of such withdrawal. At the time and place said written bi,ls
are opened and declared, oral bids which exceed the highest written
bid submitted by at least 5%, will likewise be received from
responsible bidders. All bids, written or oral, shall remain open and
subject to acceptance for a ypriod of thirty (30) days after the bids
are opened and declared. The City Council reserve the right to reject
any and all bids, to waive any informalities in the bidding and to
withdraw the property from sale. In the event of cancellation of sale
and./or rejection of bids, the respective security deposits shall be
refunded without interest.

4. Security Deposit: A deposit of $10,000 (ten thousand dollars) must
accompany) each sealed written bid. The security deposit must be in
the form of a Cashier's Check, and serves as guarantee that the high
bidder will enter into an escrow and day the purchase price. All
checks shall be payable to the City of National City.
The difference between the amount submitted as security deposit and
the purchase price, specified in Clause 5, Terms, need not be
presented at the time bids are opened and declared, but must be
deposited with the escrow holder prior to close of escrow. All bid
security deposits shall be retained by the City of National City until
selection of the successful bidders.
5. Terms. The balance of the purchase price shall be paid prior to the
Close of Escrow.
6. Escrow: Within ten (10) days after acceptance of bids, by the City
Council, the City will open a 60 day escrow. The successful bidder
shall day all costs, including recording fees, documentary transfer
tax stamps, or other real estate transaction taxes or fees by whatever
name known, or any other costs, including escrow fees.
7. Title: The City of National City will convey its right, title and
interest in the property described herein by Quitclaim Deed. The
right, title and interest in the property to be sold shall not exceed
that vested in the City of National City, and the sale is subject to
all title exemptions and reservations, whether or not of record. A
preliminary title report is on file and available for inspection at
the City of National City, Engineering Department, 1243 National City,
California 92050. The City of National City assumes no liability for
any possible encumbrances, either of record or not of record, and
assumes no responsibility for the accuracy of said report. No
liability is assumed as to zoning or availability of utilities. The
City will pay for the title insurance policy.
8. Commission: No commission will be paid for the sale of this property.
9. Open House: The City will make the property available for inspection
on Friday July 20, 1990 from 10:00 a.m. to 12:00 p.m.
10. Special Conditions: Buyer should be aware of the following
conditions:
1. Interested parties should conduct a field examination.
2. This property is sold in an "as is" condition.

It is understood that the City Council of the City of National City
reserves the right to reject this bid and that this bid shall remain oden
and subject to acceptance by said Council for a deriod of thirty (30) days
after the date sdecified in said Notice for the opening of written bids.
In the event this bid is accepted by the City Council within such thirty
(30) day Period, or within such further time as may be agreed udon by the
undersigned and the City Council, and the undersigned fails to enter into
and complete the escrow for the sale and Purchase of said real Property
within a reasonable time after the undersigned is notified that said escrow
has been opened, the undersigned shall Pay to and forfeit the security
deposit to the City of National City.
