HomeMy WebLinkAboutCC RESO 16,306RESOLUTION NO. 16,306 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA ADOPTING AN AMENDMENT TO THE GENERAL PLAN. CASE FTT.R NOS.: GP-3-89/ZC-10-90 APPLICANTS: JOHN & LOIS TENWOLDE WHEREAS, the City Council considered the recommendation and findings of the Planning Cb mission for approval of an amendment to the General Plan to change the land use designations on the Combined General Plan/Zoning Map, along with evidence and testimony presented at the duly advertised public hearing held by the City Council on July 24, 1990; and, WHEREAS, the Planning Commission and City Council have caused and duly held studies and proceedings for the timely amendment to the General Plan of the City of National City, pursuant to Title 7, Chapter 3, Article 6 of the Government Code of the State of California; and, WHEREAS, the Planning Commission at a duly advertised public hearing held on May 21, 1990 considered the proposed amendment to the General Plan of The City of National City, along with all evidence and testimony presented at said hearing, and along with the proposed Negative Declaration together with any comments received; and, WHEREAS, the City Council recognizes the need and desirability to conduct reviews of, and consider amendments to, the General Plan to accommodate the changing needs of the ccsmiunity. NOW, THEREFORE BE IT RESOLVED that the City Council has considered the proposed Negative Declaration together with any comments received during the public review process and all evidence and testimony presented at the hearing and finds that on the basis of the Initial Study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment, approves the proposed Negative Declaration, and authorizes the filing of a Notice of Determination. BE IT FURTHER RESOLVED that the City Council finds that the proposed amendment is in the public interest and is consistent with General Plan policies to promote a high quality urban environment with stable neighborhoods and to preserve existing housing and neighborhoods. BE IT FURTHER RESOLVED that the City Council hereby amends the land use designations of the General Plan on the Combined General Plan/Zoning Map from RS-3-PD, Residential, Single -Family Extendable -Planned Development, to RM-1- PD, Residential, Multi -Family Extendable -planned Development, for properties between "D" Avenue and the alley immediately west of "D" Avenue, south of 30th Street and north of 31st Street, as further described by case file exhibit (GP-3- 89/ZC-10-90) on file in the office of the City Clerk as Exhibit "A", subject to the following conditions: 1. Prior to any new construction, a boundary adjustment shall be processed to relocate the northerly property line of the property identified as APN 562-253-07, 16.1 ft. further northward. 2. Prior to the approval of any building or occupancy permit for any parcel all street improvements adjacent to the parcel, as specified by the National City Engineering Department shall be installed per City specifications. 3. The applicant shall sign and have notarized an Acceptance Form, provided by the Planning Department, acknowledging and accepting all conditions imposed upon the approval of this amendment. The applicant shall also submit evidence to the satisfaction of the Planning Director that a Notice of Restriction on Real Property is recorded with the County Recorder. The applicant shall pay necessary recording fees to the County. The notice of Restriction shall provide information that conditions imposed by approval of the General Plan Amendment/Zone Change are binding on all present or future interest holders or estate holders of the property. The Notice of Restriction shall be approved as to form by the City Attorney and signed by the Planning Director prior to recordation. PASSED AND ADOPTED this 7th day of August, 1990. (g4jG4E1A-7(.1.
