HomeMy WebLinkAboutCC RESO 91-60RESOLUTION NO. 91-60 A RESOLUTION OF THE CITY COUNCIL Or THE CITY OF NATIONAL CITY, CALIFORNIA, ADOPTING AN AMENDMENT NDM ENT TO THE LCP, LAND USE PLAN, AND TO THE COMBI.NL:D GENERAL PLAN/ZONING MAP FROM OS -CZ TO ML-PD-CZ FOR 0.66 ACRES AT THE NORTHWEST CORNER OF NATIONAL CITY BOULEVARD AND 33RD Sa t,+;'1'. APPLICANT: TFICUPS MOYNAHAN, JR. CASE FT P NO. GP-3-90, ZC-12-90, LCP-1991-1 WhEtSEAS, pursuant to Division 20 Section 30000, et.seq. of the California Public Resources Code, the California C'stal Act, a Local Coastal Program for the City of National City was prepared and adopted, and WHEREAS, pursuant to Section 30503 of the Public Resources Code and Section 65351 of the California Government Code, the Planning canrission and City Council held duly advertised public hearings on an amendment to said Local Coastal Program, Land Use Plan, to change the Land Use Plan designation from OS to C for excess freeway parcels sold by Caltrans north of the Rt. 54 freeway west of National City Boulevard, and an amendment to the implementing designations on the Combined General Plan/Zoning Map fruu OS -CZ to ML-PD-CZ, for the parcel at the northwest corner of National City Boulevard and 331d Street, and all persons interested were given opportunity to he heard, and the City Council considered the recommendation of the Planning Commission for approval of gid amendments, along with evidence and testimony presented at the duly advertised hearing held by City Council on March 26, 1991, and WHEREAS, the Planning Commission and City Council have caused and duly held studies and proceedings for the timely amendment to the General Plan of the City of National City, pursuant to Title 7, Chapter 3, Article 6 of the Government Code of the State of California; and, WHEREAS, the Planning February 4, 1991 considered testimony presented at said Declaration together with any Commission at a duly advertised public hearing held on the proposed amendments along with all evidence and hearing, and along with the proposed Negative comments received; and WHEREAS, the City Council recognizes the nc-c and desirability to conduct reviews of, and consider amendments to, the General Plan to accommodate the changing needs of the cornrmunity. NOW, THEREFORE BE 1.1RESOLVED that the City Council has considered the proposed Negative Declaration together with any cents received during the public review process and all evidence and testimony presented at the hhring and finds that on the hasis of the Initial Study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment, approves the proposed Negative Declaration, and authorizes the filing of a Notice of Determination. Page 2 of 3 Resolution No. 91- 6 0 BE IT FURTHER RESOLVED that the City Council finds that the proposed amendment to the Local Coastal Program, Land Use Plan, is in the public interest and consistent with Coastal Act policies, since the OS designation was applied by the Land Use Plan to reflect freeway right-of-way, the amendment area has been determined not needed for freeway purposes and has been sold, the amendment area contains no unique open space values, and it is oeparated from coastal areas by freeway improvements. BE IT FURTHER RESOLVED that the City Council finds that the proposed amendment, from OS to ML, is consistent with and adequate to carry out the C, commercial automotive, designation of the Local Coastal Program (Land Use Plan), since the C designation of the land use plan is applied to existing light manufacturing and commercial uses and zone designations in the area, and all applicable development regulations applied by the local coastal program implementation for the ML zone will be applied to the amendment area. 7F IT FURTDr:R RESOLVED that the City Council finds that the PD overlay is consistent with the Local Coastal Program, Land Use Plan, and General Plan policies since it will allow additional discretion for design review, including landscape setbacks exceeding minimal requirements of the Land Use Code at an important entryway to the City and the Mile -of -Cars; and other unique characteristics of the site, such as irregular parcel shape and adjacent freeway location, warrant discretionary review of future, site development plans. 7F IT FURTHER RESOLVED that the City Council hereby amends the Land Use Plan designations of the Local Coastal Program from OS (Open Space) to C (Commercial Automotive) for the area north of the Rt. 54 Freeway west of National City Boulevard, as further described by case file exhibit (LCP-1991-1) on file in the Office of the City Clerk as Exhibit "A". BE IT FURTHER RESOLVED that the City Council hereby amends the Combined General Plan/Zoning Map from OS -CZ (Open Space -Coastal Zone) toML-PD-CZ (Light Manufacturing -Planned Development -Coastal Zone) for a 0.66 acre parcel at the northwest corner of 33rd Street and National City Boulevard, as further described by case file exhibit (GP-3-90, ZC-12-90, LCP-1991-1) on file in the Office of the City Clerk as Exhibit "B". BE IT FURTHER RESOLVED that the City Council hereby certifies that the Local Coastal Program: is intended to be carried out in a manner fully in conformity with the California Coastal Act; BE IT FURTHER RESOLVED that the Director of Planning is authorized to submit copies of this resolution and exhibits to the California Coastal Commission for approval and certification.
