RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NATIONAL CITY CONSENTING TO FINANCIAL PARTICIPATION
BY THE COMMUNITY DEVELOPMENT COMMISSION
OF THE CITY OF NATIONAL CITY IN CONSTRUCTION
OF A NEW POLICE FACILITY AND IN
CAPITAL IMPROVEMENT PROJECTS TO BE CONSTRUCTED
WITHIN THE REDEVELOPMENT PROJECT BOUNDARY
WHEREAS, the Community Redevelopment Law (Health and
Safety Code, Division 24, Part I) provides, at Section 33445, that
the Community Development Commission (CDC), in its capacity as
Redevelopment Agency, may pay all or part of the cost of
construction or reconstruction of a publicly owned building or
structure and may enter into agreements with the City for this
purpose; and
WHEREAS, the CDC wishes to assist the City of National
City in the financing of the construction of a new Police Facility,
and in the construction of capital improvement projects to be
constructed by the City within the redevelopment project boundary;
and
WHEREAS, the site of said buildings, facilities and
improvements is within the National City Downtown Redevelopment
Project, adopted by City Ordinance No. 1762 on December 1, 1981,
and said buildings, facilities and improvements will be of benefit
to the Project; and
WHEREAS, on June 11, 1991, in the City Council Chambers,
Civic Center, 1243 National City Boulevard, National City, the City
Council of the City of National City held the hearing required by
Section 33679 of the Health and Safety Code, at which hearing the
City Council considered oral and documentary evidence concerning
the financial participation of the CDC in the construction of a new
Police Facility and in the construction of capital improvement
projects to be constructed by the City within the redevelopment
project boundary.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of National City that the City Council hereby finds and
determines as follows:
(1) That the new police facility will provide a unique
opportunity to create a strong identity for city government
within the City, and specifically within the immediate
neighborhood at the terminus of Civic Center Drive and
National City Boulevard. Locating the new police facility
directly across the street from the existing Civic Center will
create a complex of centralized governmental functions and

buildings in one geographic area within the project boundaries
which will serve as a centerpiece for the redevelopment area
specifically, and the City generally.
(2) That since the new policy facility will be a major
focus in the immediate area, it will help set a standard and
tone for future redevelopment in the neighborhood.
(3) That the revitalization of the area surrounding the
Civic Center under the City's redevelopment program will draw
on the private initiative of developers, retailers and
property owners to invest in the long-term economic
development of the neighborhood. As a link to downtown
redevelopment, the project will provide a strong image for the
City and as a result of public investment, will serve to
attract and stimulate private investment.
(4) That the project will become a key area of economic
development because of its relationship with the downtown area
and its accessibility to the freeway system. Installation and
construction of public buildings and facilities will serve to
upgrade and beautify the area through public improvements.
(5) That development of the project will create a
community focus of public spaces encouraging new private
retail and commercial activities compatible with the
governmental center.
(6) That the annual expenditure of CDC funds for capital
improvement projects to be constructed by the City will
provide for the installation of needed City buildings,
facilities, structures, and other improvements, and for the
rehabilitation, modernization, and maintenance of existing
buildings, facilities, structures, and improvements which are
funded under the City's capital improvements project (C.I.P.)
program.
(7) That the proposed buildings, facilities, structures
and other related improvements are within the National City
Downtown Redevelopment Project, which consists of 2,080 acres
or about one-half of the land area and about one-half of the
population of the City, and are of substantial benefit to the
National City Downtown Redevelopment Project Area and to the
inhabitants thereof.
(8) That the net effect of both Articles XIIIA and XIIIB
of the California Constitution (commonly known as Propositions
13 and 4) is to impose severe constraints on the City's
ability to finance the proposed police facility and to carry

out needed capital improvement projects. Proposition 13 on
the one hand effectively restricts the City's ability to raise
revenues. Proposition 4 on the other hand limits the City's
authority to appropriate revenues from existing sources.
(9) That no reasonable means of financing the police
facility and all needed capital improvement projects are
available. Neither the City's operating resources nor its
reserve funds will support the full financing requirements of
such projects.
BE IT FURTHER RESOLVED by the City Council that the
Council consents to payment by the Community Development Commission
of the City of National City of one-half the cost of the new Police
Facility, and beginning July 1, 1992, to payment by the Commission
of the greater of $320,000 or 10 percent of the amount of CDC funds
allocated annually for neighborhood improvement and for commercial
and industrial redevelopment, to be devoted each year during the
duration of the Redevelopment Plan to capital improvement projects
to be constructed by the City within the redevelopment project
area.
BE IT FURTHER RESOLVED that the City of National City
intends to enter into agreements with the CDC for these purposes
and said agreements will create an indebtedness of the Commission
for the purpose of carrying out the National City Downtown
Redevelopment Project.
