RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NATIONAL CITY AUTHORIZING
THE CITY MANAGER TO TAKE THE NECESSARY ACTION
TO ADOPT A QUALIFYING RETIREMENT PLAN FOR
PART-TIME, TEMPORARY AND SEASONAL EMPLOYEES
WHEREAS, the Omnibus Reconciliation Act of 1990
(OBRA) expanded Social Security Coverage for state and local
government employees. After July 1, 1991, all employees,
including part-time, temporary and seasonal employees (PTS)
employees must participate in Social Security unless they
participate in a "retirement system"; and
WHEREAS, on April 10, 1991, the Department of the
Treasury and the Internal Revenue Service (IRS) released
proposed regulations relative to this expansion, whereby other
options are available under OBRA; and
WHEREAS, as an interim measure, the Finance Director
recommends that PTS employees be covered by Social Security,
while other, less expensive, retirement systems are
investigated.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of National City that the City Council authorizes
the City Manager to take the necessary actions to adopt Social
Security as a qualifying retirement plan under the Omnibus
Reconciliation Act of 1990 (OBRA), for part-time, temporary
and seasonal employees.
BE IT FURTHER RESOLVED that the City Manager is
authorized and directed to investigate less expensive
alternatives to Social Security that meet the requirements of
OBRA, and to cease participating in Social Security in favor
of a less expensive alternative when one is available.
PASSED and ADOPTED this 25th day of June, 1991.
