HomeMy WebLinkAboutCC RESO 92-184RESOLUTION NO. 9 2-18!4 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY INITIATING PROCEDURES FOR A REORGANIZATION TO BE KNOWN AS THE REO DRIVE REORGANIZATION AN-1992-1 WHEREAS, the City Council of the City of National City desires to initiate procedures for the hereinafter described reorganization; and WHEREAS, the City Council of the City of National City desires to be named as the "conducting agency"; and WHEREAS, the territory affected by the proposed reorganization, described below, is included in National City's sphere of influence, adopted by the Local Agency Formation Commission; and WHEREAS, THE General Plan of the City of National City designates the extension of Reo Drive through the affected territory; and WHEREAS, the City Council on October 6, 1992 approved an amendment to the Combined General Plan/Zoning Map to establish the GP-PZ (RS-2-PUD) prezoning designation for the affected territory; NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED by the City Council of the City of National City as follows: SECTION 1. Proposal is hereby made to the Local Agency Formation Commission of the County of San Diego for the following reorganization: A. Proposal is made pursuant to Division 3, Title 5 of the Government Code known and cited as the Cortese -Knox Local Government Reorganization Act of 1985, commencing with Section 56000 of the California Government Code. B. The change in organization proposed is the annexation of the affected territory to the City of National City and the detachment of said territory from the Bonita-Sunnyside Fire Protection District and the South Bay Irrigation District. The affected territory is depicted on the map attached hereto as Exhibit "A" and includes 1.00 acre of property, identified as assessor parcel no. 564-290-71, is currently bordered by the National City incorporated boundary on the south, west and north, and by privately owned property in the unincorporated area on the east, and is included in the National City sphere of influence approved by the Local Agency Formation Commission June 3, 1985. D. The reason for the reorganization is to attach territory to the City of National City so that said territory can become a part of said City and receive the benefits of all municipal services now provided by said City to its inhabitants and properties within the City. E. This reorganization shall be known as the Reo Drive Reorganization. SECTION 2. By this resolution the City Council of the City of National City requests that the Local Agency Formation Commission of San Diego County undertake proceedings for the reorganization pursuant to the Cortese -Knox Local Government Reorganization Act of 1985, commencing with Section 56000 of the California Government Code. SECTION 3. The City Council of the City of National City hereby requests that it be designated as the "conducting agency" and that the City of National City be authorized to order the proposed reorganization. SECTION 4. The City Council of the City of National City has considered the proposed negative declaration (IS-1992-2) together with any comments received during the public review process and all evidence and testimony presented and finds that on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment, approves the proposed negative declaration, and authorizes the filing of a Notice of Determination. SECl1ON 5. The City Council authorizes the Planning Director to submit required information and filing fees with the Local Agency Formation Commission of the County of San Diego for filing of an application for the proposed reorganization. SECTION 6. The City Clerk of the City of National City is hereby authorized and directed to file a certified copy of this resolution with the executive officer of the Local Agency Formation Commission of the County of San Diego.
