HomeMy WebLinkAboutCC RESO 92-85RESOLUTION NO. 92-85 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ACCEPTING THE OFFER OF THE COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF NATIONAL CITY (CDC) TO BUY CITY OWNED SURPLUS LAND FOR $652,400 WHEREAS, the City Council of the City of National City on March 17, 1992, by adoption of Resolution No. 92-40, approved a Comprehensive Housing Affordability Strategy (CHAS), a five year housing and community development projection, consisting of 85 pages, which was transmitted to the U.S. Department of Housing and Urban Development (HUD) for its review and approval and HUD has approved the CHAS; and WHEREAS, the City Council, on March 17, 1992, also approved CHAS Housing Programs, 1991-1992, including a Home Improvement Loan Program, $375,000, a First Time Homebuyers Program $187,500 and a Rental Rehabilitation Program $175,000 for a total of $750,000 using CDC tax increment 20% set aside money and $750,000 (HUD $576,000 and State of California $174,000) HOME Grant Funds for the production of housing for very large, very low income families through the Metropolitan Area Advisory Committee (MAAC), Community Housing Development Organization (CHDO); and WHEREAS, the City owns property which is surplus to the City's needs and which is suitable for approximately 12 home sites for first time homebuyers and two planned developments for approximately 4 rental units each for very large, very low income families with Section 8 Housing Assistance; and WHEREAS, the CDC, by adoption of Resolution No. 92-11 (Housing) on March 17, 1992, authorized an appraisal of parcels numbered 11, 12, 13, 21, 31, 33, 41, 44, 51, 52, 53 and 54 on the list of City owned real properties dated December 3, 1991 by Truman Brooks, Realtor and Appraiser, Bonita, California for $3,200 and Truman Brooks completed his appraisal on April 7, 1992 and the Executive Director of the CDC reviewed each appraisal report and recommended approval thereof and also recommended that the CDC offer to buy the appraised properties from the City at their appraised values which total $652,400 subject to clear marketable title of each such property and subject to the City reimbursing the CDC for title reports, title insurance in the amount of the purchase price of each parcel and one half of the escrow fees; and Continued on Page Two Resolution No. 92-85 Page 2 of 2 WHEREAS, the CDC Board considered the appraisal reports by Truman Brooks and the recommendation of the Executive Director and the Board authorized the Executive Director to make the offer; and WHEREAS, the City Council has considered the individual Appraisal Reports and the Appraisal Summary by Truman Brooks, Realtor and Appraiser, Bonita, California dated April 7, 1992 and the City Council wished to accept the CDC's offer in the amount of $652,400 subject to the CDC receiving clear marketable title of each such property and subject to the City reimbursing the Commission for title reports, title insurance in the amount of the purchase price of each parcel, and one half of the escrow fees; and WHEREAS, the City has made the written offers to sell or lease the subject properties to the entities specified in Government Code Section 54222, and none of said entities has notified the City of its intent to purchase or lease said properties as required by Government Code Section 54222. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City that the Mayor is hereby authorized to convey the City owned parcels to the Community Development Commission for the appraised values set forth in Appraisal by Truman Brooks, Realtor and Appraiser dated April 7, 1992 subject to clear marketable title of each such property and subject to the City reimbursing the Commission for title reports, title insurance in the amount of the purchase price of each parcel and one half of the escrow fees.
