HomeMy WebLinkAboutCC RESO 92-129RESOLUTION NO. 92-129 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY CONSENTING TO THE USE OF COMMUNITY DEVELOPMENT COMMISSION TAX INCREMENT FUNDS TO ASSIST IN THE CONSTRUCTION OF PHASE III STREETSCAPE, 8TH STREET FROM I-5 TO HARBOR DRIVE WHEREAS, the California Community Redevelopment Law, Health and Safety Code, Division 24, Part I, (the Law) provides at Section 33445 that the Community Development Commission (CDC) may finance all or part of the cost of the construction of any building, facility, structure, or other improvement which is publicly owned, either within or without the project area, with the consent of the legislative body, if the legislative body makes certain findings; and WHEREAS, the Community Development Commission of the City of National City (CDC), by adoption of Resolution No. 91-55 (NCDRP) on November 5, 1991, approved a Final Plan of Streetscape, 8th Street, I-5 to Harbor Drive, authorized the Executive Director to advertise the Project for competitive bids and authorized Budget Revision II, 1991-1992 CDC Budget in the amount of $176,542 of CDC funds in order to proceed with the Project; and WHEREAS, the CDC has advertised for competitive bids and wishes to award a Contract and to proceed with the Project and the City Council also wishes to proceed with the Project. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of National City finds as follows: (1) Pursuant to Section 33445 of the California Health and Safety Code, it is hereby found and determined that the payment by the Communi- ty Development Commission of approximately $151,542 as provided in the CDC Preliminary Budget adopted by the CDC on May 15, 1992 for Construction of Phase III Streetscape, 8th Street from I-5 to Harbor Boulevard, abutting the Downtown Redevelopment Project and leading into the four corners at 8th Street and National City Continued on Page Two Resolution No. 92-129 Page Two of Two ' Boulevard where the CDC has invested approximately $7 million and private redevelopers will invest approximately $30 million, is hereby determined to be of benefit to the National City Downtown Redevel- opment Project Area, which consists of 2,086 acres or approximately 44% of the City's land area. (2) That the proposed use of tax increment funds for said public improvements is and will be of benefit to the National City Down- town Redevelopment Project and to the immediate neighborhood in which the project is located. (3) No other reasonable means of financing said improvements are available to the City of National City. BE IT FURTHER RESOLVED that the City Council hereby consents to the use of approximately $151,542 of CDC Tax Increment Funds for the construction of Phase III Streetscape, 8th Street from I-5 to Harbor Drive.
