This COVENANT is made by ROGELIO AND EMERITA TIPAY hereinafter
referred to as "OWNERS". WHEREAS OWNERS are the owners of that certain real
property located in the City of National City, County of San Diego, State
of California, described as follows:
LOT 377, LINCOLN ACRES ANNEX NO. 2, MAP 1748
(A.P.N. 558-330-17)
WHEREAS, said owner desires tote excused from the legal requirements
to install the following improvements:
AT 2208 & 2210 RACHAEL AVENUE FRONTING FUTURE HARBISON AVENUE:
A) 66 LINEAL FEET 6" TYPE "G" CURB AND GUTTER
B) 330 SQUARE FEET SIDEWALK
C) 1221 SQUARE FEET OF A.C. PAVEMENT AND BASE
D) ADDITIONAL IMPROVEMENTS SUCH AS DRAINAGE ITEMS & UTILITIES.
NOW, THEREFORE, in consideration for the granting of a deferral to
install said improvements by the City Council of the City of National City,
said owners covenant for
THEMSELVES and
THEIR

administrators as follows:
1. The owner will not protest the installation of any of the required
improvements under 1913-15 Inrovemnt Act Program whether initiated
by the property owners or the City.
2. The owner will install said improvements in conjunction with an
overall improvement program of the area whether initiated by the
property owners or the City.
3. The owner will install the required improvements within 30 (Thirty)
days of a written demand to do so by the City Engineer.
