HomeMy WebLinkAboutCC RESO 93-6RESOLUTION NO. 9 3-6 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA, ORDERING THE "REO DRIVE REORGANIZATION' (LAFCO REFERENCE NO. RO-92-17, CITY CASE NO. AN-1992-1) WHEREAS, the Local Agency Formation Commission of the County of San Diego adopted a resolution on January 4, 1993, making determinations and approving the "Reo Drive Reorganization" consisting of annexation to National City and detachment from the South Bay Irrigation District and the Bonita Sunnyside Fire Protection District for territory whose boundaries are described in Exhibit A attached hereto; and WHEREAS, the Local Agency Formation Commission has determined that the territory includes 1.15 acres and is uninhabited; and WHEREAS, the reorganization was proposed by the City, the property owner, to attach territory to the City of National City so that said territory can become a part of the City and receive the benefits of all municipal services now provided by the City to its inhabitants and properties within the City; and WHEREAS, the regular County assessment roll will be utilized; and WHEREAS, the affected territory will not be taxed for any existing bonded indebtedness or contractual obligation; and WHEREAS, no condition was placed upon the reorganization by the Local Agency Formation Commission except for conformance of territory boundaries to those described in Exhibit "A"; and WHEREAS, the City Council considered the proposed negative declaration (IS-1992-2) for the proposed reorganization on October 6, 1992, together with any comments received during the public review process and all evidence and testimony presented and found on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment, approved the proposed negative declaration, and authorized the filing of a Notice of Determination; and WHEREAS, the action is being taken pursuant to the Cortese Knox Local Government Reorganization Act of 1985; and CONTINUED ON PAGE 2 Resolution No. 9 3-6 Page 2 of 2 WHEREAS, the Local Agency Formation Commission authorized the City Council to conduct proceedings as the conducting authority for the reorganization without notice and hearing. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of National City hereby orders the proposed "Reo Drive Reorganization" consisting of annexation to National City and detachment from the South Bay Irrigation District and the Bonita Sunnyside Fire Protection District for territory whose boundaries are described in Exhibit A attached hereto, and directs the City Clerk to transmit six certified copies of this resolution, including the approved legal description and map, to the executive officer of the Local Agency Formation Commission. Thence north 72°11'41" east along the southerly line of said northwest quarter to the intersection with the southwesterly line of Road Survey No. 620 (Valley Road), 40 feet wide, map filed in December, 1934 and on file in the County Engineer's Office of said county; 2. Thence westerly and northwesterly along said southwesterly line to the intersection with the westerly tine of said quarter section 83, being also the easterly line of said quarter section 100, said point of intersection being distant thereon, north 18°34'50" west, 84.93 feet from the east quarter corner of said quarter section 100; 3. Thence south 18°34'50" east along said easterly line to a point which is distant thereon north 18°34'50" west, 14.56 feet from said east quarter corner; 4. Thence leaving said easterly line south 19°36'06" west, 27.55 feet; 5. Thence south 18°34'50" east, 14.56 feet; 6. Thence south 19°36'06" west, 91.53 feet to an angle point in the northwesterly boundary of Parcel 2 of the land described in deed to Fred McCormick, et ux, recorded October 15, 1959 as Document No. 213446; 7. Thence north 70°23'54" west, 64.21 feet; 8. Thence south 19°36'06" west, 268.51 feet to a point in the northerly line of the southerly three -fifths of the easterly half of the northeast quarter of the southeast quarter of said quarter section 100; 9. Thence north 71 °27'50" east, 290.00 feet along said northerly line to the easterly line of said quarter section 100; 10.
