RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY
REQUESTING IMMEDIATE ACTION BY THE
STATE DEPARTMENT OF TOXIC SUBSTANCE CONTROL
TO STABILIZE AND CLEANUP A HAZARDOUS WASTE SITE
WHEREAS, Nelco Oil Refining Inc., located at 600 West 12th Street in
National City, California, was the site of a hazardous waste treatment and storage
operation; and
WHEREAS, the owners of the site filed bankruptcy in 1990 and to date
have not cleaned up the site; and
WHEREAS, thousands of gallons of waste oil and other hazardous waste
remain at this facility. The facility has become progressively unstable over the past few
months and waste from the hazardous waste containers has leaked into the public roadway
and into the storm drains; and
WHEREAS, recent heavy rainfall has made this site very unstable and
increased the risk to public health and safety; and
WHEREAS, testing has shown there exists at the site potential for
contamination of the groundwater; and
WHEREAS, the site is the responsibility of the State Department of Toxic
Substance Control - Facilities Management Unit. The State has not been successful in
getting the owners to cleanup the site.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of National City that the City Council hereby supports the recommendations of the San
Diego County Department of Health Services, Hazardous Materials Management
Division, that immediate action to mitigate and cleanup the hazard be taken by the State
Department of Toxic Substance Control and that the owners of the facility be prosecuted
to the fullest extent of the law for abandoning the facility and threatening the health and
safety of our citizens and damaging our environment.
