HomeMy WebLinkAboutCC RESO 93-41RESOLUTION NO. 93-41 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, APPROVING A CONDITIONAL USE PERMIT FOR EXPANSION OF A MOBILE HOME PARK AT 999 DIVISION STREET APPLICANT: LEWIS DORIA CASE FILE NO. CUP-1991-15 WHEREAS, the appeal to the City Council of the Planning Commission's approval of Conditional Use Permit (CUP-1991-15) was considered by the City Council of the City of National City at public hearing held on March 23, 1993 at which time oral and documentary evidence was presented; and, WHEREAS, at said public hearing the City Council considered the staff report prepared for Case File Nos. CUP-1991-15 and IS-1991-28 which is maintained by the City, and incorporated herein by reference; and, WHEREAS, this action is taken pursuant to all applicable procedures required by State and City law; and, WHEREAS, this action recited herein is found to be essential for the preservation of public health, safety and general welfare. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City, California, that the testimony and evidence presented to the City Council at the public hearing held on March 23, 1993 support the following findings: 1. That the site for the proposed use is adequate in size and shape, because the project provides adequate area for the proposed expansion of the trailer park, parking, access, open space, and circulation. 2. That the site has sufficient access to streets and highways that are adequate in width and pavement type to carry the volume and type of traffic generated by the proposed use, since the park has direct access to Division Street, an arterial roadway of adequate capacity to accommodate the additional 85 average daily vehicle trips the expansion is expected to generate. 3. That the proposed use will not have an adverse effect upon adjacent or abutting properties, since the additional seventeen coaches will be placed on currently vacant property. Adjacent land uses consist of apartments upon which the residences are not expected to place a burden. To the south and east are single-family residences which are physically separated from the park by topography and Division Street. Landscaping and screening requirements as required by Title 18 will further reduce any potential adverse effects. Resolution No. 93-41 4. That the proposed use is deemed essential and desirable to the public convenience or welfare, since the expansion of the mobile home park will provide for the orderly expansion of the existing park and will provide a variety of housing opportunities in accordance with General Plan policy. BE IT FURTHER RESOLVED that the City Council has considered the proposed Negative Declaration No. IS-1991-28, together with any comments received during the public review process, and finds on the basis of the Initial Study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment, approves the Negative Declaration, and authorizes the filing of a Notice of Determination. BE IT FURTHER RESOLVED that the application for Conditional Use Permit is approved subject to the following conditions: 1. Before this permit shall become effective, the applicant shall submit evidence to the City of National City that the existing park and proposed expansion area have received the approval of the State Department of Housing. 2. School fees shall be paid as per Section 18.88.60 of the Municipal Code. 3. A soils report and plans shall be submitted to the Building and Safety Department. 4. Administrative costs (microfilm, etc.) of the City shall be paid prior to final approval of development. 5. A grading and drainage plan showing all proposed and existing on -site and off -site improvements shall be submitted to the Engineering Department. The plan shall be prepared by a Registered Civil Engineer in accordance with the City's standard requirements and shall show the following: a. Top of curb elevations on Eta Street and at the A.C. berm in front of the expansion area. b. The structural section for the proposed A.C. pavement at the expansion area. The structural section shall be designed by the soils engineer, and shall not be less than 2 inches A.C. over 4 inches Class II A.B. c. The existing drainage easements within the property. There shall be no conflict between the easements and the new mobile homes. If it is determined that the mobile homes will encroach onto the City easements, the applicant shall execute an encroachment agreement or agreements with the City, as required by the City Engineer. Resolution No. 93-41 d. Earth work quantities associated with any re -grading of the site, such as cut at the existing southerly slopes, or any import for additional fill. The cut slopes shall not be in excess of 2 to 1. e. The type and elevations of the proposed retaining wall. f. The dimensions of the proposed access road (e.g. widths, turning radii, curve data, grades.). 6. Hydrology and hydraulic calculations shall be submitted addressing the amount of the new surface runoff from the proposed addition and the method of conveyance of this runoff from the site. The calculations shall include the runoff from the top of the proposed cut slopes. The drainage study shall investigate the capacities of the existing on -site catch basin and the underground 60 inch RCP storm drain pipe crossing the project site. If the storm drain is determined to be deficient in size, the drainage study shall include recommendations for the upgrading of the drainage system and shall be subject to approval by the Engineering Department. The developer shall be responsible for the construction of any required improvements. 7. An addendum to the existing soils report shall be prepared and submitted to the Engineering Department addressing the stability of the existing and the proposed slopes within the property. 8. A sewer permit will be required. The method of sewage collection and disposal from the mobile homes shall be shown on the plans. 9. Two deteriorated portions of the asphalt concrete pavement and base on Eta Street, as described below, shall be removed and replaced with new 3 inches A.C. over 8 inches A.B. pavement section. The areas of repair have been marked in the field and consist of a 20 foot by 96 foot section and a 9 foot by 40 foot section. 10. A permit shall be obtained from the Engineering Department for all improvement work within the public right-of-way and any grading operations on private property. 11. A cost estimate shall be submitted with the plans. A performance bond equal to the approved cost estimate for all of the proposed drainage, landscaping, retaining wall work, and for any grading and street improvement work shall be posted. Three percent (3 %) of the estimated cost shall be deposited with the City for inspection and plan checking costs at the time the plans are submitted. The performance bond shall be posted prior to the approval of any permits for the construction of the mobile homes. 12. A title report shall be submitted to the Engineering Department for review of all existing easements and ownerships affecting the property. 13. The existing guard rail on Eta Street shall be completely removed from the public right-of- way. Resolution No. 93-41 14. The applicant shall remove the existing asphalt path along the southerly side of Eta Street adjacent to the mobile home park. The applicant shall install landscaping in the area of the removed asphalt path in accordance with the standards of the Planning Department. The applicant shall install a new concrete sidewalk in accordance with City's standards along the northerly side of Division Street. 15. Access to the 35 ft. wide gate at the north end of the property off Eta Street shall be maintained in order to allow use of the fire hydrant at that location and facilitate the movement of apparatus through the park in accordance with the Uniform Fire Code. 16. Fire lanes shall be provided along the new access road and on both sides of the gate area, as referenced in #15. Parking shall be prohibited in these areas. 17. The access road will be required to be a minimum of 20 feet of unobstructed width and paved with all weather surface. 18. The entire trailer park shall be enclosed with chain link fencing no less than eight feet in height with view obscuring vinyl slats or similar material subject to the approval of the Planning Director. 19. The parcels which comprise the mobile home park (APNs 551-570-09, 10, 11,and 12) shall be merged to form one parcel. 20. The bank along the southerly property line in the existing portion of the park shall be planted with trees and shrubs in accordance with National City's Guidelines for On -site Landscaping. 21. Prior to any person taking occupancy of any coach in the expansion area, the applicant shall have the landscaping installed in accordance with Exhibit B-revised, dated 1/22/93. The park operator shall contact the Planning Department and request an inspection of the landscaping. 22. Hose bibs shall be provided for each new home site. 23. The perimeter and common area landscaping shall have permanent underground irrigation. 24. Except as otherwise required by these conditions of approval, the development of this site shall be in accordance with the provisions of the National City Land Use Code. 25. Development plans shall be submitted and approved by the Planning Director in conformance with Exhibits "A-2nd Revision" (dated 10/2/92) and B-revised (dated 1/22/93), Case File No. CUP- 1991-15. 26. The gates on Eta Street shall remain closed and locked except for the movement of coaches during installation and removal, and for emergency access. The method of securing the gates shall be subject to approval of the Fire and Police Departments. Resolution No. 93-41 27. Laundry facilities shall be provided and maintained in accordance with 18.16.430 of the National City Land Use Code. The use of the existing permanent structures within the park shall be limited to an office, the storage of personal items owned by tenants of the park and for the laundry facilities. 28. Before this conditional use permit shall become effective, the applicant shall sign and have notarized an Acceptance Form, provided by the Planning Department, acknowledging and accepting all conditions imposed upon the approval of this permit. Failure to return the signed and notarized Acceptance Form within 30 days of its receipt shall automatically terminate the conditional use permit. The applicant shall also submit evidence to the satisfaction of the Planning Director that a Notice of Restriction on Real Property is recorded with the County Recorder. The applicant shall pay necessary recording fees to the County. The Notice of Restriction shall provide information that conditions imposed by approval of Conditional Use Permit No. CUP-1991-15 are binding on all present or future interest holders or estate holders of the property. The Notice of Restriction shall be approved as to form by the City Attorney and signed by the Planning Director prior to recordation. 29. The use of the property as authorized by this conditional use permit is limited to the expansion of an existing mobile home park by 17 residences (total 89 spaces). 30. This permit shall become null and void if not exercised within one year after adoption of the resolution of approval unless extended according to procedures specified in Section 18.116.190 of the Municipal Code. 31. Prior to the approval of any permits for grading or for construction or installation of any new buildings or coaches, verification shall be provided from the Sweetwater Authority that water service will be provided. The developer shall submit a letter to the Sweetwater Authority stating fire flow requirements and shall enter into an agreement for water facility improvements with the Authority prior to approval of the building permit. BE IT FURTHER RESOLVED that copies of this resolution shall be transmitted forthwith to the applicant; and, BE IT FURTHER RESOLVED that this Resolution shall become effective and final on the day following the City Council meeting where the resolution is adopted. The time within which judicial review of this decision may be sought is governed by the provisions of Code of Civil Procedure Section 1094.6.
